Ability To Withdraw Applications

Okay - this is what I decided. Please tell me if this was foolish or mediocre.

I have a small wedding planned for 5 months and 2 days from today. I went ahead and applied for K1. I am hoping the K1 gets accepted in five months. The way I see it - this will enable her to come here fastest. If it is not accepted in five months, I figure I'll just withdraw the K1 completely, get married, and then apply for K3. Obviously this will take longer. Basically - K1 approved in time, she is here with me in January. If not, she's here with me by June via K3.

Thoughts? :help:

K-3 Visa

07/22/2006 - Applied for K1 - I-129F mailed to Vermont Service Center, VSC

08/02/2006 - Package got sent back requesting a different form (different revision). Proceeded to weep like a girl. Decided against fiance visa with newfound setback. Will wait for December wedding.

12/24/2006 - Marriage

02/05/2007 - I-130 sent to VSC and confirmed receipt following day.

02/13/2007 - I-130 NOA1 received

02/15/2007 - K-3 sent to Chicago and confirmed receipt following day.

02/26/2007 - K-3 NOA1

03/02/2007 - I-129F (K-3) sent to Vermont Service Center (from Missouri Service Center)

03/11/2007 - Received email notice: I-129F in VSC is now pending (whatever the heck that means)

04/05/2007 - I-130 and K-3 APPROVED! (email notice) (rec'd postal mail 04/13)

04/09/2007 - NVC received case (called 603 334 0700)

04/11/2007 - Shipped to Chennai.

05/17/2007 - Received confirmation of receiving package via postal mail in India with interview date! (took 36 days!)

06/15/2007 - Interview! VISA APPROVED!!

06/29/2007 - She's in my arms...

Where are you planning to get married if the K1 is not approved in 5 months?

Jen

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

Having a wedding in India is a lot cheaper. So if there is no approval in five months, the wedding probably will be in India. Followed by a US-reception (after K3 approval). I'm starting to get nauseous.

Do you really want to wait that long to get married?

Perhaps if you're already nauseous, you need that time to be ready....

Sounds a bit unlikey that a K3 will be approved in 5 months.

He's talking about the K1 being approved in 5 months.. if not, they'll abandon the K1, marry in India, and pursue the K3.

OP: Why wait the 5 mos then... might as well marry now and count that 5 mos toward your K3... you'll need every bit of it, and then some....

January to June is 5 months.

Past and current timelines are on this site, but a K3 is usually a lot longer.

I have read that the K-3 can be a MINIMUM of 8 months!

k-1 is fastest and if it isn't approved in 5 months, why would something that takes longer be completed in the same timeframe?

I would tend to agree, get married and go the K-3 route instead of wasting time on the k-1, even then June might be a bit optomistic.

Okay. Ouch. Well for obvious logistic reasons the earliest time that we can get married will be December. With that said - I opted for the sliver of chance of getting K1 approved. So the end result will be either REALLY GOOD (K1 approval) or REALLY BAD (lonely 2007).

If something dramatic changes and I can get married say in August, is it easy to withdraw my K1 filed application?

You have a chance with Vermont, I do not know what the delay is like in India.

As I understand it once it is in the system you can not stop it, but you would be just starting again anyway.

You should have no problem doing the whole process in 5 month. Usually Vermont is quite fast and after the new Imbra Law settels down the process will go faster again.

exactly there is no way anyone can even begin to guess how long a K-1 will take. It depends on many factors, the country, the embassy, the couple (if there are red flags concerning) etc. I had planned a FEb 2006 wedding. (sigh) We applied in June of 2005 and we are still waiting. (but again ours was a little outside the norm) Ive seen visa's approved in four months and I've seen people who are still waiting after a couple of years. Either way Good Luck, I hope that yours is a success story!!!!
