Tax Return Info for ROC

Ok, I called the IRS to get tax transcripts and their system was down. They said call back later in the week and it might be fixed, blah blah blah. I want to get this I-751 sent off ASAP. I went ahead and requested the transcripts by fax, to have them mailed to me, but I'm not sure when I'll get them. I was able to hunt around and find copies of my tax returns from 2006, 2007, and 2008 (all filed jointly since marriage). I am going to send these copies and hope they are enough. But if we do get an RFE, we should have the IRS transcripts in hand by then.

So, my question is should I just send my 1040 forms, or should I send the whole thing including Schedule C, EIC, Child Tax Credit, etc? Do they really want all that info or are they mainly concerned with whether or not we filed jointly? What tax info did you send? Did you get an RFE or an approval?

You need to send everything to show your taxes/income.

1040's/W-2's etc...

One without the other will result in an RFI - that is why getting a transcript is best (has all your info)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I thought the main purpose of the tax info was showing that your assets are combined, not income?

I thought the main purpose of the tax info was showing that your assets are combined, not income?

My guess is you got the conservative answer. USCIS can easily find out whether you sent them the proper copies or not, and I doubt anyone would send fake copies of their 1040s - this is fraud. I sent mine the way you did, so I will post a thread if I receive an RFE and if tax returns were an item they need additional documentation on.

I wouldn't worry to much about it at the moment. Also, I would call again the next day and not wait a few more. They always say call later.

The best bet is to get official government transcripts (which by the way don't look very official). When I was applying for original gc, I didn't know that and I just sent photocopies of my tax return papers and they didn't care..

Ah - that is what your using them for... (should of looked at your timeline) - yes - in this case, they want to see you two are together.

So you probably will not need all the schedules - the 1040's/W-2 should be sufficient.

Timeline

I got impatient and sent them copies of my 1040. However I also sent in copies of the electronic refund to our bank acct and emails showing receipt of our tax filings.

I did order copies of the transcripts after sending it in just in case.

If you have a copy of the refund receipt or bank history of getting it deposited you can also send that along as proof of filing. No RFE and was approved within 3 months (yay!).

10/29/2009 - Biometrics taken. Whole process took about 40 min including the wait

12/22/2009 - Approved for ROC!

01/08/2010 - Received text and email: Card production ordered

01/15/2010 - Received Green Card in the mail!

04/22/2011 - Express Mailed Application for Naturalization

04/27/2011 - Check cashed by USCIS

04/28/2011 - Received NOA I-797C dated 04/26/2011

05/27/2011 - Biometrics taken. Process took approx 35 min with wait

07/29/2011 - Received Interview Appt letter scheduled for 09/01/2011 dated 07/26/2011

09/01/2011 - Interview and Oath. Now a USC! The VJ is over!
