Timeline

I am asking this question on behalf of someone. She got married to a US CITIZEN in Dec 09, her I -20 expired may 09. She is to graduate from college in 10. Currently she is out of status. Will this affect her F1. what can she do now and what forms do she need to fill to change her status to F1

If she is married - she cannot use the K-1.

Was she a student, got married in the US, and now wants to AOS?

If she was a student - what was written on her I-94? If it says "D/S" only an immigration judge can state she is 'out of status'.

She should be in the process of doing the AOS - where is she at on that?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Bobby you are on point. The 1-94 says D/S . She is some forms already filled. Her 1-20 expired last year may and on one of the forms the ask for the expiration date what should she write there. Secondly they ask for the expiration date of the i-94 what should she write or just write DS
