Just wondering..what could the criteria be?

We filed more than 5 months ago for my husband's AOS and have heard nothing much..We see folks getting transferred and approved within 30 days and kind of discouraging...especially seeing we have pretty much the same type of backgrounds..K1 entry...never married...low fraud country..etc.

Could we be being penalised for not doing DORA program?

09 JUN 2006.....regular EAD approval

14 JUN 2006.....regular EAD recieved in mail

22 JUL 2006......AOS and EAD (?) touched...moving along maybe? :)

21 AUG 2006....Recieved interview letter!

26 SEP 2006.....INTERVIEW!!!!!!!!!!!!

26 SEP 2006.....APPROVED WITH FLYING COLORS!

05 OCT 2006....Welcome letter recieved

11 OCT 2006....THE CARD ARRIVES!!!!!!!!!!

15 SEP 2008.....Sent for removal of conditions

24 SEP 2008.....NOA for removal of conditions

10 MAR 2009....Transferred from VSC to CSC

22 MAY 2009.....REMOVAL OF CONDITIONS APPROVED!!!!!! :) Citizenship here we come!

I believe it's the same as when you get your first approvals. They take a bunch of applications and throw them up in the air. The ones that land on the top of the pile get approved faster than those on the bottom.....seriously, I think a lot of people would sleep better if we only knew the answer to that question.....

at first, i thought it was just for people that were married and filed within the 90 days of arrival... but that's not so because there have been CSC transfers for people who filed after the 90 days.

they need to get rid of the backlog so hopefully there will be more CSC transfers in future... (pick me, pick ME, PICK ME!!!) :lol:

we can only speculate as they aren't talking... :whistle:

The I-485 package is reviewed by the people at the NBC. If the application seems clearly approvable based on the documentation that has been submitted it is sent to the CSC. If the people at the CSC agree they approve it. If they do not agree they send it back to the NBC.

If the application does not seem to be clearly approvable it is sent to the local DO or SO for interview and decision.

"pretty much" doesn't cut it. The 'devil' is in the details, not the superficiality, of the situation. And in how those details appear based on the content - not the type - of the documentation that has been provided.

I'm curious as to what you mean by "clearly approvable" . Considering that no proof of relationship is sent in with the I-485, how can some have "better" documentation than others. My husband, for example, was approved with no interview, but his file didn't include anything other than the standard requirements (marriage certificate, I-864, etc.) I'm wondering what could possibly have made his case more approvable than others, when we all send in the same stuff.

If the application does not seem to be clearly approvable it is sent to the local DO or SO for interview and decision.

Thats a great point!!! It doesn't make any sense to me either!!! My guess was if there was backlog at that DO or something they send some. Also maybe there is something that the consular officers document on our paperwork after our interviews for the visas. Maybe they can say that they don't think an interview is needed for AOS! Thats a long shot but maybe......

Excellent question, to which I have no answer. I do not know what the decision criteria for 'clearly approvable' are (I wonder if there's anything put into the Adjudicator's Field Manual about this ...).

As for documentation of the case, there's the brown envelope from the consulate that was turned in to CBP on entry.

(on second thought, maybe it was the $100 dollar bill with CSC written on it enclosed with my husband's I-485 application that did the trick ;) I kid, I kid!)
