F1 on Hb1 status married to an american citizen going to college.

Hello, My name is Travis and I just got married to my really sweet wife name rachel, we both were in college when we met and we graduated the same month but went different colleges, she got accepted in grad school in another state and I as an international go my hb-1 status and started working to payoff my loan.

We decided to get married in August before she left for grad school. She comes visit me alot but I yet have not been able to visit her. its been hard getting a permanent job in this economy and I had three jobs to keep up with my loans. My HB-1 status is up in May so I decided to file for AOS in February. Can some one help here. Whats the best way to file for AOS for my status and how to approach and what to bring to the interview.

Read the guides above - they will tell you what you need for the AOS.

The only issue you may have is that your wife is in another state - so you may want to get a lot of evidence showing that the marriage was entered in good faith, and not for immigration purposes.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Since a H-1b is a dual intent visa it may not be as big an issue but in any case the marriage needs to be bonafide relationship

Well the marriage was entered in good faith, but she got a scholarship to Vanderbuilt University,we plan on living in Indiana, which was where we met, she wants to come back and be a professor and her former college so her stay in Tenesee is tempoary for just two years. All of our friends live here and this is a place we want to raise out kids.

ANd we live the same apartment she just goes to grad school in Tenesee. So far since married she comes home for breaks and holidays.

So All i need to do is fill out two files?
