i understand but with I sent about 6 pay stubs and the letter from my employer together with the affidavit of support for him to bring to the interview and they reviewed and said not enough income:

heres the deal:

I have only been workin at frys 6 months now. I make 11 an hour and am full time. on the employment letter they don't say "annual salay" but instead "year-to-date" salary which comes out to about7-8grand.

We get paid weekly so- my weekly pay is about 300 plus. but in a month itself without having the deductions removed - in an annual month I make = $1650, in an annual month = so an annual income per year i would make = $19800. = this is making 37.50 hours per week.

i don't know what to do... getting a lawyer today to evaluate and help me out - don't want this to turn to just a blue.

When they ask for verification of current income, the only thing you can do is send more current pay stubs. Your pay stubs will indicate the number of hours and hourly rate. They can do the calculations. If your income is not sufficient, they can deny the visa. Your income appears to meet the published minimum requirements for 2009, but it is still a judgment call for the Consular officer to make.

It's critical that you see the full written notice and provide that information in context. Your interpretation of its meaning may or may not be correct. We can help you with complete information from the notice but there are no guaranteed results for any visa process.

they just want me to provde a "Evidence of current sustained income"

- the interviewer also marked affidavit of support but then crossed it out again.

- They made him fill out air21 but have not paid

- they also asked him to provide his passport when providing the needed documents

- i know some people are outright denied with low income so i'm sad and happy at the same time that we were given this chance.

I just hope I knew what kind of sustained income they needed.

- they also gave him a year to complete this. I hope to complete this within this month or next month.

To me, you are wasting your time and money getting a lawyer. Calm down and think this through. None of this process has happened overnight and a lawyer is not going to make that change. All they want is additional paperwork.

Ask your employer to write out an estimated annual salary letter. Ask them to explain you have only been there 6 months, but that you have a good work performance etc., (Anything they can say to help.) and then resubmit the required information. If they said to bring the passport to the next meeting, all they want is this proof and you SHOULD be good to go. Get the info together, and get it in the mail.

thank you for all the replies. i should be getting in touch soon with an update on what I am going to do

- i still have yet to call the immigration in manila about this to get more information

- it's just frustrating to hope for the pink and instead find white and blue.

- i hope we will get through this "obstacle." I appreciate all the time everyone is taking making and giving me comments.

Third or fourth but last request. You are still giving us your interpretation. If you give us the full text of the notice, we can help you properly interpret the request and how to respond. Without that, you really don't need us because we're just shooting in the dark.

I thought 40 hours per week was considered full time work, I know a lot of employers keep employee's work weeks limited to 38 hours or less so they can be classified as part-time, and the employer does not have to provide a lot of the benefits and insurance normally required for full-time employees. Do you think the VO could be considering your job part-time employment?

That's exactly it !

to the OP - did you provide an employment letter, that had a statement about:

1. your hire date

2. your job title

3. your annual salary amount

signed by the HR Rep at your company, on company letterhead?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

it says on the white piece of papers:

" current sustained income" -- that was the only one checked that they needed from ME the applicant and:

" valid passport" - from my FIANCE

it also says:

" When you have all required marked above, submit them at windows 17-20 from 1pm to 2pm monday through thursday except friday"

this is all that was stated on the white slip that was given to hiim and the blue slip was a checklist of what was needed from me and him.

for his interview i sent:

- affidavit of support

- letter from employer

- 6 current paystubs for the month of december

- bank account information

- life insurance information

I do not know exactly what is required to show " CURRENT SUSTAINED INCOME" that is why I am getting an attorney so that I won't mess up again - I don' want the whites to turn into blue.

The interviewer told him to bring the additional documents as soon as he is able

- asked him about the interview(personality wise) - said he was very nice and could speak tagalog, only "problem" is income.

- my current job now: I work at fry's electornics and make 11 an hour. I am full time and get paid weekly - my weekly hours are 37.5-38

- I have been working there since July 13 of 2009

Does full-time in US means permanent/regular? Is your current job your first? I guess there's a probation period before an employee gets premanent. If full-time means permanent, then I guess I can't think of any reason why your income doesn't meet the requirement. However, if full-time doesn't mean the same as permanent, I guess that's what they're looking for. Just a thought though.

- As for my last year income tax return - I only made 7grand because I went back home and stayed in the Philippines for 11months, came back here in California(originally from hawaii) then found a job - FRYS (it is my second job here in cali, first at wendy's but resigned due to no full time hours)

- like stated before, I make 11 an hour and work 37.5-38 weekly - i have been there since July 13 of 2009.

- I thought that the affidavit of support only needs annual income from current job which i equal to = 21450 = if calculated estimated annual salary per year.

- At frys: they don't say what is estimated annual income and they don't disclose work performace. for reason they have "systemized" way of obtaining work verification.

- I got a lawyer to help me not mess up because I don't want the white to turn to blue. -

- My fiance told me that the consular officer said " this can not be." but gave him a 2 white slips and 1 blue. IF they said "this can not be" why not just outright deny it then?? Instead of me having to go through all the trouble of getting paperwork done and everything else.

- I just hope I can clear our of this problem soon. I feel helpless now that I don't know what I am doing. My fiance and I are both frustrated as we have anticipated him coming here this month - I just hope everything turns out the way we expected them to be.

You can probably request for another employment letter stating there that your position is permanent as the term "permanent" essentially means that the employer will not terminate an employment contract under normal condition. I was just wondering though why your income didn't meet the requirement. When I had my interview I wasn't even asked for my fiance's paystubs/employment letter/bank statement but he's been with the company for years already. Maybe that's what they're looking for. They just want to be sure that your employment is stable considering that you've been with your current for employer for only 6 months.

Tell the store manager you need this letter for immigration purpose and the letter need to say the following

- Date of hire

- Position

-Full Time or part time

- how much you get paid an hour ( most likely they can only give you the base pay rate as most frys employees get paid commission)

If the store manager doesn't want to help you write it then talk to HR and explain the samething. Although i don't remember any HR being in the actual store.. unless something changed...

hey that happens to me during my interview, they said my husband has insufficient money to support me but when i review my papers, it really enough for a k1 petition so what i did was just i submit thesame papers and i just added a letter from his job, stating his annual income, letter of employment stating the date hired, monthly salary, etc... i didnt use co sponsor, i just submitted thesame papers...
