ok quick question.

my fiancee (she is my wife now :) ) here and our daughter. little one has k2 visa and i am trying to do aos for both. how long time i have before i apply ? their i-94 exp. 18 aug-2012 ...

i know i have to pay 1070$ fee for aos but do i have to do that for both separate or same time? and do i have to pay 1070 or 2140 $ ? thank you for the help

[*] 15 May 2013 - Moved from MN to LA; [*] 17 May 2013 - Applied for a new SS card/filed an AR-11 online (unsuccessfully), therefore called and spoke to a Tier 2 and changed the address; [*] 22 May 2013 - Address updated on My Case Status (finally can see the case numbers online); [*] 28 May 2013 - Letter received in the mail confirming the change of address; [*] 31 July 2013 - Went to Romania; [*] 12 September 2013 - returned to the US using the AP, POE Houston, everything went smoothly; [*] 20 September 2013 - Spoke to a Tier2 and put in a service request; [*] 23 September 2013 - Got "Possible Interview Waiver" letter (originally sent on August, 29th to my old address, returned and re-routed to my current address); [*] 1 October 2013 - Started a new job.

No, the I-485 application based on a K-1 and subsequent marriage does not require proof of a bona fide marriage. Just the marriage cert :)

Not for the packet, no. For the interview (if there is one - there isn't always for a K1 Adjuster) you take evidence of co-mingling like bank accounts etc.

Quick Question - Do you guys think it will be ok for me to submit the same 'Employment Letter' that I submitted for my Husbands K-1 Visa Interview a couple months ago, even though the letter will be dated back a few months? I have current pay stubs to show that my income is still the same...

I would think not personally. Because the letter has a signature on it, the payslips could easily be forged. If you have a hard time getting the letter from your employer you could try submitting the same letter and if you get RFE'd then you know for sure :) You wouldn't get denied for sending the old letter, just RFE'd.

On June 27, 2012, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to another office for processing and sent you a notice explaining this action.

It's either a transfer for interview, or a transfer to CSC. You'll have to wait and see.

Hello Vanessa and Tony,

I filed for my removal of conditions on 02/12/2012 and had my bio-metrics appointment on 04/18/2012, i received my one year extension by mail but havent heard anything from the USCIS yet, i have read that the usual timeline is around 5-6 months and i am around the 5th month timeframe.

Should i be worried or just wait it out another month and see what happens, how and who do i contact if i go past my 6 month timeline if i dont get my conditions removed.

All the help would be appreciated

10/29/07: First time we met in Bangalore

11/19/07: Realized we were in love

02/22/08: Her next trip to India

04/18/08: She left India

05/30/08: My first trip to US

06/09/08: Left for India

02/12/09: Visited her again for Valentines

05/27/09: Mailed application to Vermont Service Center

06/01/09: Received NOA1

07/09/09: Visited her again in US

09/13/09: Received NOA2

09/22/09: Beth received letter from National Visa Center saying package was received and will be forwarded to Chennai within the week

09/25/09: Received email from Chennai with all the docs and interview date of October 29, 2009.

10/29/09: Interview in Chennai. Visa APPROVED!!!

12/10/09: Arrived at DFW, 5 min at the POE & i am in, apparently the officer who interviewed got his wife to USA on K1 visa,what an irony

02/14/10: Wedding at Southfork Ranch in Dallas Texas

02/14/10: Headed for a honeymoon in Las Vegas :)

02/17/10: Back from honeymoon

02/22/10: Started thinking about AOS,EAD,AP (its too much paper work)

03/06/10: Filed the AOS,EAD,AP application

03/26/10: Received NOA for AOS,EAD,AP

04/05/10: Received NOA I-797C for AOS (Case transfered to CA CSC)

04/28/10: Received NOA I-797C for Bio-metrics appointment

05/18/10: Bio-Metrics taken at the Fort Worth ASC

05/20/10: Received my AP document :)

06/03/10: Received my EAD Card and a "Welcome Letter" stating my Permanent Resident Card will be mailed soon... :)

06/17/10: Received my Permanent Resident Card (Green Card) :)

I got married yesterday following my entry as a K1 on Thursday 2nd August. I have a couple of questions.

Are all three forms (AOS, EAD & AP) sent in the same pack and do you need 6 passport photo's (2 for each application) or just 2 for the whole application and is the the same with regards to passport/visa photocopies etc?

ROC for VSC is taking about 9 months. Keep an eye on the filers groups to get an idea of where you are in the process. This is the Feb ROC group: http://www.visajourney.com/forums/topic/349983-i-751-february-2012-filers/page__st__570 and you can see only 1 from VSC has their GC and that was an expedite due to deployment.

This post: http://www.visajourney.com/forums/topic/343787-i-751-january-2012-filers/page__view__findpost__p__5590568 in the January filers group says 1 person from VSC in the December group has been approved. You'll be waiting another 3 months at least i would think.

You need 6 photos and photocopies go with each form. The packets are separated and processed separately. they are individual applications and you need to submit their individual required evidence.

Also is the affadavit of support to be filled in by myself (AOS applicant) or my wife (USC)?

I'm really confused by all this, is the OP and documents listed in the OP still up to date? They took all my forms/papers when I entered the US on a K-1 visa and I haven't got them back. Will I need any of those forms? Also, why do I need another affidavit of support if I already prepared one to get the visa?

I found this instruction page for the I-485 and it doesn't mention all the forms in the OP, but I'm assuming it's up to date.
