Trying to follow this guide for the AOS

Finding some of it difficult to understand

Im on the I-131 form, date of intended departure.... I dont plan to leave unless its an emergency, what do I put there?

unknown for both fields. Also there is mention of a letter to attach explaining eligibility or something, you don't do that as AOS is your eligibility.

Cashiers cheque is fine but personal cheque is better (for you) because you'll see when they've cashed it, you can (if you have online banking) have a look at the cancelled cheque that will have your case number on the back.

Its been a while that i have been on here, almost time for me to renew my AOS in February, however i had a simple question, me and my wife are taking a cruise to Southern Caribbean in January for a week and i believe my Conditional Green Card (Valid until 05/2012) should be sufficient enough for me to leave and come back into the country correct. My passport is good till 2016.

I want the folks on VJ to assure me even though i know i am correct :)

10/29/07: First time we met in Bangalore

11/19/07: Realized we were in love

02/22/08: Her next trip to India

04/18/08: She left India

05/30/08: My first trip to US

06/09/08: Left for India

02/12/09: Visited her again for Valentines

05/27/09: Mailed application to Vermont Service Center

06/01/09: Received NOA1

07/09/09: Visited her again in US

09/13/09: Received NOA2

09/22/09: Beth received letter from National Visa Center saying package was received and will be forwarded to Chennai within the week

09/25/09: Received email from Chennai with all the docs and interview date of October 29, 2009.

10/29/09: Interview in Chennai. Visa APPROVED!!!

12/10/09: Arrived at DFW, 5 min at the POE & i am in, apparently the officer who interviewed got his wife to USA on K1 visa,what an irony

02/14/10: Wedding at Southfork Ranch in Dallas Texas

02/14/10: Headed for a honeymoon in Las Vegas :)

02/17/10: Back from honeymoon

02/22/10: Started thinking about AOS,EAD,AP (its too much paper work)

03/06/10: Filed the AOS,EAD,AP application

03/26/10: Received NOA for AOS,EAD,AP

04/05/10: Received NOA I-797C for AOS (Case transfered to CA CSC)

04/28/10: Received NOA I-797C for Bio-metrics appointment

05/18/10: Bio-Metrics taken at the Fort Worth ASC

05/20/10: Received my AP document :)

06/03/10: Received my EAD Card and a "Welcome Letter" stating my Permanent Resident Card will be mailed soon... :)

06/17/10: Received my Permanent Resident Card (Green Card) :)

You're not "renewing your AOS". AOS stands for Adjustment of Status. So you will actually be applying for Removal of Conditions (ROC).

Yes your GC is still valid so you'll be fine :D

Thank you for the great post. I have one question, what does the following mean? I obviously don't work but what are the residence attachments?

The G-324A wants employment and residence info and I have too many previous addresses and employers to fit on the form so I had to include another piece of paper (one for employer and one for residence) with the full list. Thank you for this very detailed guide Vanessa :) I am almost done preparing my documents but I am bit confused with the I-864's supporting documents. What is the difference between income tax return and tax transcripts? My husband doesn't get income tax return because he paid his taxes at the end of the year.

what do you mean he doesn't get an income tax return? An income tax return is something he files at the end of the year with the IRS. There are state and federal taxes. For immigration purposes only federal taxes matter.

An income tax return is made up of W2's (he getss these from his employer), 1040's (this is the tax form) as well as sometimes 1099's, 2555's and whatever else relates to his tax situation (say he owns a house there are forms for that as well). Once he files his taxes with the IRS he will either get a refund (they pay him back any tax that he as overpaid), OR he will owe money (hasn't paid enough tax during the year). An income tax return can be made up of quite a lot of paper. Mine are over 20 pages long and they can be over 50 pages long depending on your personal situation and ALL those pages MUST be sent to USCIS. An IRS transcript on the other hand is like a shorthand version. Some are only 4 pages long. one of the issues with sending tax returns as opposed to tax transcripts is sometimes people forget to include all of the forms with the tax return and get an RFE for missing info. A transcript is all that info in one and there's no risk of forgetting part.

Make sense? Your husband should know all this anyway but it's good that you're trying to learn so I hope that makes sense :)
