My wife and daughters I-751 was returned to us today coz, get this. My step daughter's resident date is over 90 days after my wife's. My wife's date is Jan 9 and my daughter's is April 30. The reason is becoz the moron's in our Govt' LOST my daughter's medical file at the interview so we had to send them another one a week or so later which is why her card was issued after my wife's. So now they want us to file seperate I-751's and of course PAY the filing fee twice also!!!! How nice of them!! I HATE this Govt. This is pathetic... they have cost me thousands $$ extra since the start and EVERYTIME it's THEIR FAULT not mine.

I'm gonna talk to my congressman on Wed. and see our options. I'm hoping I can get a waiver since it was their #### up to begin with but who knows.

Has anyone else had this or something similar happen. I really don't feel like paying $425 more just becoz they screwed up.

You are not alone, neither in your sentiments or experience. I have seen at least a couple other cases like yours here. You have to file twice and pay twice because they screwed up. :angry:

The last time I heard of this happening (thankfully it's not that common) I seem to recall the child filed later - included all necessary supporting evidence along with an explanation as to why they ended up filing separately (I believe they also included the parent's NOA1 from their I-751) and were not required to pay the additional fee (the biometrics they did have to pay of course). I can't seem to find the thread - it may have been a while back but that is my recollection of the outcome.

I'm not familiar with this particular scenario, but I have heard of people having to pay extra because of mistakes made by USCIS.

In cases where time wasn't an issue, like when fees went up, I heard of some people having files returned incorrectly asking for the higher fee, but then using proof of original mailing evidence to resubmit the form with the lower fee, which was correct for the original filing.

Unfortunately the small window of time for the I-751 doesn't give you much leeway. Right now you have to get your wife's I-751 refiled. Jan 9th is only 4 days away.

If possible, visit your local USCIS office and ask to speak to a supervisor. Be prepared for the run around but insist on them sending the regional office an email explaining your situation and for them to contact you with the response. This is the only way I got them to fix my wife's expedited travel documents which they did not expedite after I paid the extra fees for the expedite. I talked to the local congressman and all he got was the same generic answer I did about the no refund policy. It took 9 months of writing and visiting the office but i eventually got the fees refunded. Basically be the squeaky wheel and do not give up. The Government employees and offices forget they work for the tax paying citizens and we do not work for them.

We are just a few weeks away from our 90 day window for filing for the removal of conditions. Hope we do not have issues because the closest office is in Dallas, 4 hours away.

I think you might be taking the correct path - talking to your congressman. USCIS gets by with too many mistakes that get dumped on the filers, and we always feel cornered because we feel powerless to negotiate it. If we do, then we will fail to meet one of their ridiculously long list of rules and find ourselves needing to file more, pay more and end up with some weird document explaining how we "screwed" it up.

Thanks, That's what I'm doing. Filing them separately but together and ask for a waiver of fee for the child's petition. What a pain they've caused me again. The Govt is consistent though! Consistently incompetent!!!!

Anyone who wants this Govt Health Care to pass should have to experience USCIS!! They can't do immigration paperwork how could they handle 1/6 of our economy??? Jeeez

It is $545, and then to add insult to injury you have to pay a biometrics fee for the daughter and no biometrics will be performed due to her age. And then when she turns 14 you need to renew the card despite what the expiry date on the card says
