Can anyone tell me how much time will it take for my native embassy, [ i would probably be going to the nearest consulate in new york rather than the embassy in Washington ] to issue me a duplicate passport, and what can I so that my family doesn't come to know about it ? Will my family or parents be questioned if i just state the passport stolen and ask for a duplicate, what is the procedure for that ?

You can ask them for an emergency passport. It may take a day or 2. Not sure if you have to go there or if you can send your application by mail.

The dilemma for me is that i don't want my family to be hurt even after i am gone from their lives, i don't want any criminal proceedings against them, after all they have raised and supported me for the last 23 years, and this is not the way i wanna repay them back by putting up charges against them, call me cynical or whatever but yes i do love my family even after what they are doing to me, I just want to get out of ths situation without them or me getting hurt or prosecuted for anything, I hope some of you might understand where i am coming from.

Here is the thing, you can't travel out of India without your passport, so 1 of the 5 relatives you are traveling with will have your passport, also when you stand in line at the immigration section in US, they WILL have to hand you over your passport.

Point is, you will have your passport with you when you enter US, there is no other way around. So all you have to do is come up with the money to go to your native country. I would assume your country is likely to help you out with the plane tickets and a safe refuge.

You will have to risk your family into this, there is no other way around. You said your parents are not US citizen, so most probably they won't be questioned, also the relatives you are going with may simply deny any involvement into forcefully marrying you off. In that case, ask for help with IO, tell them you just want to get to the nearest consulate of your country and I am sure they will help you. Your relatives can't stop you in that kind of a situation where law officers are present right there.

Another point is thatthey require me to be present in US while the green card procedure takes place, since i haven't signed any other forms so that means i would be going back on a student visa (right as sachinsky said) and can't be absent for school or then i will be reported, so they are probably going to want me to switch schools to come to new york and then have me stay with him till the green card procedure is done with, this means that i will have to go back to NJ to get myself transferred, and this will give me a little time window for getting the duplicate passport can i then be in any position to take care of this situation without me and them getting prosecuted,

That would be good, but I doubt they will let you go by yourself. If you are traveling with 5 imagine in the US that your/his whole family lives there?

Also if i were to get transferred that would probably happen only after the current semester which is commencing on 19th Jan and ends on 15th of May ? or can i transfer in between or just at the starting of my academic semester, from what i have searche u have to apply for a transfer in the preceeding semester and then get a letter of confirmation from the school u want to be transferred too right ?

To get another passport you just have to go to the spanish embassy and tell them you need a replacement passport for whatever reasons (stole, lost, etc)

You will not get the student visa stamp though.

Also, very important!! You need to get your I-94 from your passport once you enter america before your relatives take it away from you.

This is the proof you entered the US legally.

If you go this route your relatives will not get in trouble, as you are just going to get a new passport and run away.

The problem is if they don't allow you to leave the house and stalk you everywhere you go. Then you would not be able to go to the Embassy.

The transfers do not happen in one day, but you will only need to go to the school for one day or 2. You don't need to be there while they are processing the transfer. So be careful if you chose this way.

If you are planning to leave for Spain why does it concern you? It doesn't matter really.

What is this I - 94, i have no idea, and what if they check the passport and see it missing, also if i have entered US then doesn't that in itself imply that i entered legally ?

When you get to the United States all you have to do is talk to the Immigration Officer. Q: What is an Arrival-Departure Record and why do I need one?

A: The Arrival-Departure Record (CBP Form I-94) or the Crewman Landing Permit (CBP Form I-95) shows the date you arrived in the United States and the “Admitted Until” date, the date when your authorized period of stay expires, and class of admission. If arriving by air or sea, the transportation line will provide all non-immigrants a CBP Form I-94 (for all non-immigrants except crewmen) or CBP Form I-95 (for crewmen) if you have a non-immigrant visa in your passport. Visa Waiver Program (VWP) applicants will have to complete an Arrival-Departure Record, CBP Form I-94W (see Form I-94W section on cbp.gov). If coming to the U.S. by land, you will receive a blank CBP Form I-94, I-94W, or I-95 from a CBP officer upon arrival at the U.S. port of entry. These forms will be processed at a U.S. port of entry at a land border, airport or seaport. For preclearance or preinspection ports of entry, these forms are available upon entering the CBP primary passenger processing area.

It is your responsibility to ensure that your I-94/I-94W is turned in to Customs and Border Protection (CBP) at the end of your visit to the United States.

* If you are departing by air, please turn the I-94/I-94W into the airline prior to departure.

* If you are departing by sea, please turn the I-94/I-94W into the shipping line prior to departure.

* If you are departing by land and you will not be returning to the United States within 30 days, please turn the I-94/I-94W into the Canadian or Mexican authorities upon departure from the United States.

My friend lost her passport and had to replace the I-94. She had to pay somewhere around $300 bucks. Here is the information:

What if my Form I-94 has been lost, stolen, mutilated,

or destroyed?

If your Form I-94 has been lost, stolen, mutilated, or destroyed,

you will need to apply for a replacement Form I-94 by filing a

Form I-102.

Is there also a possibility that i talk to the IO and don't inform him about everything that anyone is accompanying me, and that my parents married me who would be in Spain then, that would save my family in US right ?
