Hi,

I'm currently reside in Jamaica. I'm 40 years old with a 15 year old daughter. My 80+ year old mother who is a US citizen filed I-130 for me back in February 2007. On December 7, I received word from my family in the states saying my petition was approved by the UCSIS. I came to America for the holiday in which a letter was mailed to my mom saying, the petition was approved and further information would be sent to me the application in Jamaica. I'm oblivious to this process and would like to know what are the next steps and what I should expect within the next few months and how long will it take for me to move to America?

If you are single, you are in the F1 family preference category which takes about 4-5 years for a visa. In the next year, the NVC will contact the petitioner on how to proceed. Next step is the DS-3032, I-864, and DS-230s for you and your daughter.

If you are married, you are in the F3 family preference category which takes about 9 years for a visa. You would have another 5-6 years to wait for the NVC to contact you again.

No because visas are not available to you in either the F1 or F3 categories. Visas are available for F1 family preference cases filed before April 1, 2004, and for F3 family preference cases filed before May 22, 2001. You cannot file the I-485 unless a visa is currently available to you.

What you want does not make sense. Priority date is not current, but coming to US on a tourist visa and wanting to stay. Too many people would do this to jump the line. It will not work. Your priority date has to be current for you to file the I-485.

Don't overstay your visitor visa, it may complicate your immigration petition.
