Just bringing this over from your other thread so it's less confusing.

You wrote: "Assuming that someone at INS knew the whole case - why couldnt you sue them or get the decision reversed if they sent a letter stating ...ABC ? as for the lawyers they were interpruting INS law but if the INS were wrong then wouldn't lawyers be responsible as well."

It's hard to know what you're talking about since you don't give any details. You can sue lawyers for malpractice or negligence whatever the equivalent legal term is. Don't see how you're going to sue the government for making a mistake, but that's just IMHO.

Just what did USCIS tell you, and what does that have to do with the predicament you find yourself in now?

This sounds very similar in tone to the person aka 'her we shall not name' and if I am not wrong this person has this scenario?

if you are thinking of who i am thinking --- they did not have children together -- the OP mentioned a child.

some good responses & want to say hi to others prompting this hopeful debate.

going back to original 'assume'

you go 10 months after they sent the letter (ins)

will this cause problems for the person trying to get back in ..whether to see their child ?
