AOS question for Forum Veteran/Expert

Hi All - Haven't been around for a bit & this is my 1st post for quite a while.

If I could take a little of someones time.

Important - Question.

**assuming that the applicant has been in the country 3+ years & has been married the entire time & has received a letter for GC interview.

If your american spouse withdraws application of support

INS sends letter of leave USA immediately

you go 10 months after they sent the letter

you leave on your own accord

you are still married to the american citizen

you also have an american child.

How does this affect one coming back into the USA ?

I would greatly appreciate experience or professional advice to answer the above.

Once the immigrant has successfully AOS'ed,

HOPES -- you seem to think otherwise, please cite your source for how a sponsor can withdraw sponsorship when he or she feels like it. I'm sure many divorced persons would like to know.

Thats where you have gone wrong ?/////////////// up till that point ...another story.....?

I consider myself a textbook immigrant .. a foundation.. no errs... no crimimal association or activity ... nothing against me?

But what if your spouse refuses interview or withdrawal ?

maybe I should write a blog about this /.............unjust .............

Well, if your AOS application was based on marriage to a USC, and that marriage no longer exists at the time of the interview, you're out of luck. Makes perfect sense from the US government's perspective -- the only reason they were going to let you immigrate was because one of its citizens requested that their spouse be allowed to live in the US. If you are no longer that person's spouse, why should they let you live here.

Assuming your spouse refuses to cooperate, the only hope you will have of salvaging the situation is to see a really good immigration attorney. You indicated that you had already done that. Don't know what else anyone here could tell you.

hate to put a dampner on your honeymoon period ...reality sucks... not a word (real) from the forum advice about what really happens?

by the way I am posting under a new name & have been associated for more than a few years with this forum.

HCJ - a really good attorney is null & void & a waste of immigrants finances - unless you have a valid case of mental spouse abuse or your child is being looked after by a prostitute / crack #######/ as possession is 9/10ths of the law.

I am not in a honeymoon period and I know all about reality.... if you are a old member of this forum then you should know that a lot of help and support is given....

if things did not work out for you then for that I am sorry..... but please dont bring your bitterness in here... we dont need or want it.....

1. You're on a forum of lay persons with regard to immigration issues, and can only receive personal opinions at best. You will not find a legal advisement here.

2. You've already been told from some long-term regulars that you should probably seek legal advice on your particular situation...because that way you're getting advice that is particular to your situation, in a way that you can present all the information to someone qualified to assist you.

3. If you are a long-term member here, you would know that forum administrators do not give out advice here. They are monitors at best and are not participating members of this forum, other than to do admin type work.

4. Attacking those who are helping you with threads and advice is really rude. Some people here may be in the "honeymoon" phase as you put it. Some may never have to leave it.

I'm sorry you've had a rough go of it...and I hope you find the solutions you're seeking. If the advice to seek legal assistance is not what you were looking for, then by all means blog about it. After all, that I'm sure will help.

I'm going to keep my responses to this thread since there seems to be more info on this one. Agree we should not post on both your threads.

I am confused about where in the process you actually are. Your profile says you are about to lift conditions, but your posts seem to indicate you haven't been to your AOS interview yet and do not have a conditional GC. Which is it?

Assuming you have not gotten a GC yet -- conditional or otherwise -- and the attorneys you have consulted couldn't help you, it may be that you have exhausted all avenues and have to leave the US. I'm sorry.

As I said before -- if you have to leave, you should get a good family law attorney and work out custody arrangements for your son. If you have been the primary caretaker thus far, you may be able to get joint custody in your favor -- perhaps with your son spending Christmas break and summer vacations in the US with his dad, but the rest of the time with you in your home country.
