DOS202-663-1225 option #1, then option #0 to speak to someone

I called DoS and was told "the case is still under administrative process...Recently there were two Senators requesting the status and was told the same response"...

I asked two Senators in my state to write letters requesting case update recently.

What other thing I could do? Please advise. thanks.

nothing... when the CO is ready, then they will take action, but rarely will a congressional inquiry yeild results... should hear something soon.. call DoS once a week to see if anything has changed...

My senator sent me the e-mail response from the HCMC Consular with the following:

The case file is still pending review by a consular officer. Unfortunately, we encounter a significant number of visa applicants who are involved in fraudulent relationships entered solely for the purpose of obtaining immigration benefits. This requires that all officers take time to fully consider all aspects and facts of a case, requiring at times more in-depth investigation to verify certain facts. Due to staffing and other resource limitations this often means long waiting periods for applicants.

We will notify Ms. Nguyen directly after our assessment is completed and a determination is made on her case.

I hope this information is useful in responding to the concerns of your constituent.

Look like our case may be one of the victim affected by the fraudulent...it is so much frustrated even though they've seen evidence of our pictures and daily Yahoo's video call, etc...

Hope our case would be considered soon as we suffer each day passes by...

2 1/2 years in AP is over, visa in hand. Finally got it. Submitted updated medical July 3. Emailed consulate July 12 re: no news from consulate or EMS. July 13 consulate reply; visa approved, wait for EMS. July 18 10am VN time SMS delivered visa. And its a good thing too because I was just clearing customs at the airport in HCM at the time. She was at the airport to meet me and got the call. Yeah, I know, "don't make travel plans until you have the visa" but I rolled the dice & got lucky. Serendipity happens. This time we get on the airplane together. I guess I better start reading up on POE stories. Thank you all for your support. We are so happy, hanh phuc to be together at last.

May 29, 09, had attorney send I-129F to USCIS

June 3, 09, USCIS received I-129F

June 4, 09, USCIS I-797C, 1st NOA notice date.

Aug 28, 09, USCIS sends I-797E NOA. RFE requesting further evidence we have met within 2 years prior

Sept 3, 09, I sent updated RFE info to USCIS

Sept 8, 09 USCIS receives my info

Sept 11, 09 USCIS sends I-797C NOA--I-129F Petition approved, also forwards petition to NVC

Sept 23, 09 NVC receives approved I-129F from USCIS also forwards petition to consulate in HCMC

Dec 4, 09 Interview at HCMC Consulate, Blue slip, timeline, ex's address, medical results from Cho Ray

Jan 4, 10 Turned in timeline, ex,s address. White slip, 221(g) for lack of medical results. AP pending results.

Jan 4, 10 Cho Ray diagnosis--class A active multi drug resistant tb. Treatment time 18 to 24 months.

Jan 6, 10 I email consulate re: what do we do next, since K1 expires Jan 10, 10.

Jan 13, 10 Consulate replies--They have received all requested documents and the case is pending a CO review

Since the case is pending due to treatment of tb, the case is still active until treat-

ment is complete provided we contact the consulate every 6 months and notify

them she is under treatment to keep the file in open status.

Jan 14, 10 to July 2012 we wait.

July 2012, visa issued.

Aug 2012, Marriage in US.

Congrats! I am so happy for you. I still cant believe you guys had to wait so long. Thu and I waited for over 8 months and we complained but you guys had it way worse. Anyways, congrats and I wish you a beautiful and happy life together. Its great that you posted your results. I hope that others can learn from this. Best wishes.

Feb 27, 2012: Received email from the U.S. Consulate that our case is finished processing. Requested to submit updated Police & Medical papers.
Mar 06, 2012: Submitted updated Police & Medical papers.
Mar 21, 2012: Received K1 Visa
Apr 07, 2012: Point of Entry @ LAX

Adjustment of Status Stage
Apr 23, 2012: Got married!
Apr 30, 2012: Received Social Security Card
Jun 30, 2012: Applied for AOS
Sep 22, 2012: Received Employment Authorization Card...Still waiting for 2 yr GC

My wife just received a letter from HCMC Consulate asking for most recent Justice Record (Ly Lich Tu Phap), health record, DS-230 along with new pictures...

Could you please advise what may be the coming process for our case?

That means they are done with AP and the documents they are asking for are expired. Great news... visa is coming soon....

Right after my wife turned in the updated health and justice record, she was asked to turn in her VN passport and pay for the visa processing, and passport would be returned within 2 weeks, etc... (that was what my wife told me but she could be wrong...).

Does it mean that her visa is approved and she just needed to wait about 2 weeks for it to be done?

Please advise. Thanks.

Question: Once she comes to USA, do we have to "register to get married" at the city where I live (or we're automatically married due to the approved case)?

Please advise what important steps/procedures we would have go through once she comes here.

if you are fling for your wife and not fiance then you are already married.. if you are filing for your fiance, then the proccess varies from county to county state to state.. some have waiting periods before you can marry after you apply for the license. take a moment and fill in your timeline so we know the actual visa etc.
