In my case, my wife failed the interview on Nov. 7, 2008. The case was sent back and USCIS (California Service Center) didn't recieve the file until early June 2009. I was given 30 days to submit a rebuttal. USCIS reaffirmed the petition in August 2009 and the file was sent back to NVC for processing. NVC forwarded the case file to the Consulate in HCMC on Sept 25, 2009. I'm now just waiting for a letter of some sort from the Consulate because I have no idea what to do next until I recieve some word from them.

An attorney in the US will only process papers for you and make a rebuttal package for you. They don't go to the Consulate and fight for you. An attorney would probably be about 2k-3k to retain one.

Our case was sent back to the service center 08/2007. It was 2 years before the USCIS re-affirmed and sent it back to the NVC for processing. Now we are waiting for the consulate to receive our case so the Chief Immigrant Officer can review it and make a decision.

The last thing I got was a NOA stating that our case was forwarded to the Consulate.

The DoS has the same system that the consulate has and the consulate is supposed to update the system whenever anything happens with the case.. same as those touches at USCIS but with an explanation.. 202 663 1225 but the close at 5 and there is a long I mean very long recorded message.. 2 parts that you must listen to before you can select 0 to talk to someone... they are really nice there for the most part.. only 1 time have I gotten someone that was rude at DoS.

Who would be the best candidate to ask for help to get it hold at hcmc? Attorney? How much would it be if I hire Marc? Would they give us a detail denial letter or just the generic one like they give on the blue slip? My U.S Rep told me to wait for it to come back to USCIS then rebut and she said that's faster than keeping it there at the consulate. Anyone else in on this one?

Aww man Huong and Phung, This sucks, What was the reasoning for the denial? You didn't have enough evidence? Man get that lawyer to help you out.. I hope you get to be with your wife man. Good Luck.

The initial consulatation shouldn't cost you anything. Get in contact with Ellis. TBoneTX had good luck with his attorney as well. I'll look and find the name.

Take us off the list as well, They waited until I had left to tell us that we got denied. I think they knew we had proof of the reasons they denied us so they waited until I was gone so I could not go in and complain while it was still at HCMC. Binh goes to see Mark at 9:30 tomorrow. See if he thinks we need to do something now or wait. Huong, sorry to hear about your denial as will and also sorry to hear about LY and at the same time congrats on the upcoming baby. Jerome

Looks like a common factor in denials is Timeline...5 denials, each case CO requested at minimum a timeline...
