Hi guys, i need help filling out form I-864 question 21, i am the us citizen and petitioner, my wife and I have only one child who was born last year in the Philippines and who is already a us citizen, my question is: do i have to include our child as a dependent even though i did not claim our child on my last year's income tax?

yes... for I-864 purposes, a child's citizenship does not determine whether you include a child as a member of your household or not....

c. If you are currently married, enter "1" for your spouse?

should i enter a 1 here? even thought it says not to count anyone twice?

You would put "0" - since you counted her in line 10 (21. a)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Again - you listed her once before (counted - if you will)

You will not list (count) her again.

That is there in case the person you listed in question 10 is not your spouse... If so, you would have to count your spouse in this question.

So - if your wife is counted in 10 - do not count her a second time for that question. :)
