We sent in the I-751 on the 01.27.2010, via ExpressMail. The GC expired on 01.28.2010. Our I-751 was delivered at Saint Albans, VT on 01.28.2010 around 11am. NOA1 dated 01.29.2010. ...Not exactly following the "file early" advice, but still on time!

I'm really not sure if the USCIS will consider this on-time. This is from the I-751 instructions:

"... you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status. This is the date your conditional residence expires."

It's anyone's guess what will happen. Hopefully they will allow this. I wish you good luck!

That's true. However, if they considered it late, then they would've already mentioned it but you are correct, it's anyones guess now.

That's true. However, if they considered it late, then they would've already mentioned it but you are correct, it's anyones guess now.

I presume they're in a good shape since they received NOA1 which extends their residence for an additional year. Otherwise they would've been in removal proceedings rather than receiving an extension!

OK, I'm thinking we may have a problem. Is 2/16/2010 (President's Day) a federal holiday? Would the service centers administering biometrics be closed on a federal holiday? Our bio notice is for Monday, 2/16/2010 at 10:00 AM and I just realized that is President's day. What if we show up, and the center is closed for the day? I don't want to panic yet...but its been known to happen that bio was scheduled on such days. What recourse do we have? Anyone?

Ouch! This is tough!

My guess, if you go there (hopefully it is close by) and the office is closed, I think you can just go on Tuesday the 17th and they should accommodate you without any problems.

Hi Yurika & Jim, you bring a good point. Although the question does say Monday 2/16 so it is safer to assume the 16 is a typo. You are correct, it is the 15th.
