AOS - Affidavit of Support Help (I-864)

Timeline

OK couple things I need help with....

1. My wife's (USC) current income is $58,000 (2009) however her income for the previous 3 years is well below the poverty level because she was a student at the time. Income for 2006, 07, 08 were around $3,000. Does she have to meet the income requirements in all of the previous years, the most recent year or the current year (which she does)?

2. We can't find her tax info for 2006. Is this going to be a problem? Should we request it from the IRS or just submit the form with an explianation stating that she filed taxes but cannot locate the record? Can she call the IRS and ask for her gross income totals as we are not required to submit a copy, just the total.

Man this is NO fun! haha

Hi Matt!

For the I-864 technically you are only required to send in tax return and W2's from the most current tax year. It says this on the form instructions if you are curious about my source. Sending the returns from 2006 and 2007 are optional at this stage, but may be needed later in the process. With that said, my husband did not come close to meeting the poverty guidelines in 2006, as he was in school, but we sent the tax returns from 2006, 2007 and 2008 anyway. His low income in 2006 never cause us an issue and it never came up at our AOS interview.

Current and ongoing income is the big thing. The employer letter and recent paystubs will support her salary claim.

Sending transcripts (obtained for free by phoning the IRS 800-829-1040 ) is the preferred method. http://www.irs.gov/individuals/article/0,,id=110571,00.html That will allow her to obtain the 06 return.

Depending on when the AOS is filed it may be 07, 08, and 09 that will be expected.

Well, were filing now so it would be 06, 07, 08

So, all they care about is the fact that taxes were filed in those years no so much what the totals were? The only thing that really matters is her current on-going income of $58,000?

So once we obtain the 06 total we'll be ok?

You ought to be fine. Lower income during student years is typical.

She's got a degree now and a "career type" job. Along with a new spouse. The future is bright.
