beware of sleeping bears!!! i would trust what he is saying to you right now as much as i trust the gov't having a open decussion on medical reform!!

job loss and such could be scam to tell u he has no money!! do not sign nothing 2morrow! you need legal help!. also contact your consulate and inform them, they my have suggestions and help you on this. any advice is good especially if your going to return home.

remeber he left you and his baby!! every time they say your bad...just tell them... he left me and our child with no support or friends or family!!! he bailed out and left me home alone!!!!

The news of the day are that exspouse lost his job today. This may change the deal for the mediation tomorrow but I don't know yet. On the phone he said he intended to be very reasonable tomorrow at the mediation. Hopefully he will...

be cautious and consider earning potential.

losing job at the beginning of a custody case is standard practice for men without honor.

I suggest you call the HR department of his work and inquire his job status. He could very well be lying to you about this (he sounds like a piece of sh|t, sorry ) ..

Losing a job is the fastest way to NOT pay child support.

Hello Everyone!!!

The mediation turned out to be one of the most difficult days in my life. I left drained after 8 hours of negociations.

I obtained sole legla and physical custody of my baby and my ex-spouse got some visitations rights (he said he would come twice a year to visit but that he was not going to visit this year until summer)He signed a notarized letter for baby and I to leave the US.

He believes he will cut off my credit cards after we leave...

I married a winner...

Thank goodness you and your baby can be free from this dirt-bag. You may be heading back home a bit worse-for-the-wear after your marriage to a truly despicable person, but you get to go home and take baby home to be raised with you and your family for support. Her life (and yours) will no doubt be infinitely better away from him. Judging by his past behavior, I don't think you have to worry about him visiting twice a year. You probably won't ever see him again after you leave.

Too, you must realize, your husband is on the hook as far as financial support as far as the USCIS is concerned. The Affidavit of Support that he signed, means just that, and divorce does not cancel the fact of that support.

Ok firstly, the affidavate of support is not a legal contract saying he intends to SUPPORT you. It is a contract between him and the government that should you become a public charge(ie welfare...which you will not get if you can work...if you are a public charge you become 'deportable' also btw). So saying that you now know what the affidavate of support is.

As for child care. The court will award custody to the parent they see fittest to nuture and take care of the child and support be issued by them and through them on the state civil/domestic level. It is not the federal government's case to become involved in custody disputes unless you take your chid from the U.S. without his permission and then he can procede federally to have his child returned as it is considered abduction(recent news thing over this and the american got his child back).

So this is not an immigration issue at all. it is a state civil/domestic issue...if you need child support then you file it with the proper state civil agency and seek payment while going through the divorce procedings and/or until the child is an adult if you are awarded the custody. Depending on your age, length of marriage, and many other things the court will look at such as his personal income you may or may not recieve anything for yourself at all which is the likely outcome unless he is super rich and you are awarded alimony(highly doubtfull). If you take the child back to your country without his approval he can and will be able to get his child back...so make sure you have this approval before leaving the country with the child. I would not go on about how destitute you are, if you appear to be needing the government's assistance the government can choose to not approve anything to do with your visa/green card/etc as you will appear to be a drain on the system/tax dollars.

just my two cents...i do have some legal knowledge of this issue.
