Affidavit of Support, I-864

We have filed I-130, I-485, I-131, I-765 through marriage and I got a letter that based on the documents submitted with I-864, the income did not meet 125% of the federal poverty line for the household. My wife who's citizen does not work and I as a graduate student make $22,000 a year and poverty line for household of two is $14,570 so the 125% is $18,212. I don't know why the USCIS sent us that letter. Any idea or suggestion? Has any body been in that situation?

since she doesn't work she would need a joint sponsor, what you earned doesn't qualify for the affidavit of support if you are the one being petitioned.

Did the petitioner (USC) submit an I-864? Regardless of income the petitioner is always the primary sponsor and submits an affidavit of support.

The only thing i can think of is that as you are the beneficiary - yes you can use your income but only if it will continue legally during the AOS and I believe they require proof of that with the I-864... I'm sure it's probably all in there but maybe that part was missed...

I'm thinking they're maybe requiring a letter from the grad school showing your job will continue plus proof your visa isn't going to expire before you get your EAD.
