Hi Everyone ,

I got my approved I-130 on June 29,2009 the thing is when i came to florida i just turned 17 when i mom sent for me and my younger sister, i'm 34yrs old now. my mom is now a us citizen and uscis knows that im here and they are telling me in the letter that sent that im not eligible to file an adjustment of status application at this time. Until I file for an adjustment of status or applies for an immigrant visa, this approved petition will be stored in the their office. If the person for whom you are petitioning become s eligible to adjust status based on this petition, he or she should submit a copy of this notice with form I-485, application for perment residence. if the person for whom you are petitioning decides to apply for an immigrant visa outside the united states based on this petition the petitoner should file I-824,application for action on an approved application or petition, with this office to request that we send the petition to NVC.

the NVC processes all approved immigrant visa petitions that require consular action. The NVC also determines which consular post is appropriate consulate to complete the visa processing.

my question is when will i be eligible, will they notifiy me of my eligibility ?

Thanks to anyone that can help me this very confusing

Go hire a very good immigration lawyer.

When you turned 18 years old, you became an adult. You have chose to be in the US illegally for the last 16 years. That is going to cost you. There is no way for you to adjust your status while you are in the US. Your case can only be processed at a "consular post" which means at a US embassy or consulate. There are no consular post inside the US. You will have to leave the US to be processed. Here is your problem, if you leave the US you will be subject to a 10 year ban from reentering the US because of your long illegal presence in the US.

If you violate immigration laws, you cannot benefit from them. That is the general rule. Sorry.
