They don't NORMALLY check your I-94 on local flights I don't remember them doing that. They just cheked my passport..But yes, just to be safe, I guess you should bring all your AOS docs, etc...

But it is fully legal to fly within the united states as its still within the country?

Sorry for all the questions but its vital I go up to Michigan to meet the rest of the family who were not at my wedding, and I don't want to be turned away... The GC is just taking longer than expected now..

Oh dear you worry too much...I have heard of people traveling all the time even if they were out of status. All they need is your valid ID . Just to feel safer you can take all the documents related to your AOS application even though you just need the receipt number of your I-485. And believe me if they want to check you they will find out for sure your status just with your ID.

Have a great time at the wedding and stop worrying so much. You better worry about what you will wear since you'll meet a part of the family  .

My I-94 expired in late September and we filed for AOS in December.

But we flew to Hawaii for our honeymoon in Oktober. No problems at all!!!

They just wanted to see my passport.

(Tipp: if your passport is still in your maiden name than you should purchase your flight ticket in your maiden name too ... )

Hi everyone!

I haven’t posted here for a while… I have this very difficult situation. My husband and I had an argument last night. He started yelling at me to shut up and then he hit me. He was very drunk too.

I was crying whole night… I stayed with a Russian friend this night. I dint go home. I don’t know what to do. I didn’t call the police. I love him. And I want to go back to him. .

I don’t know what to do. He told me he is sorry. But on the other hand he told me I can’t leave him now cause I will not get green card. I don’t think he is sorry if he is saying this. He has been drinking a lot lately and got mad at me several times and was screaming. Shall I file for divorce? What do I do in situation like this? Please help

Hi everyone, went for our AOS interview today and we got approved! It was pretty muh easy, just simple questions on how we met, where we live, our phone numbers and things like that were asked.

We were told to expect the GC very soon in the mail.

Good luck to everyone expecting their approvals.

Hope you're doing alright.

Anyway, I know it's easy for me to say this because I'm not in your position, but from what I know - - men who hit their spouses once are likely to do that. again. Being drunk is not excuse as well. What he told you too is uncalled for. I sense someone who's trying to get full control over you, especially given your situation.

I suggest you speak with a councilor on domestic violence. I don't know where you are located, but in New York City, there's Sanctuary for Families. You can probably search for a group in your area here: http://www.ndvh.org/

I remember doing some volunteer work with Sanctuary a few years back and was told that migrants often fall victim because they're afraid to speak up and report to anyone because of their pending or illegal status.

I feel so strongly against domestic violence. Regardless of the situation, I feel that no man has the right to hit and abuse his spouse - physically and verbally.

Good luck.

Oh no... ='( I'm so sorry to hear about this... If he hits you again, please get help. I really don't know what to say... I think you can find more info over at http://www.visajourney.com/forums/index.php?showforum=127 (Effects of Major Family Changes on Immigration Benefits) - I know you can remove conditions if you're divorced but I don't know how it is before AOS is approved :(

I found this info in the FAQs:

http://www.visajourney.com/forums/index.ph...s-immigration-b

Q: I arrived on a K-1 visa, married the petitioner within 90 days but the marriage ended in divorce before we applied for adjustment of status, can I remain in the USA?

A: If the marriage is terminated by divorce before the couple apply to adjust to permanent resident status, the beneficiary and any derivative beneficiary (K-2) will not be eligible for permanent resident status through the former marital relationship. The USCIS requirement for an alien that entered on a K-1 visa is that marriage be concluded to the original petitioner within 90 days and that adjustment of status is possible only through the initial petitioner.

Q: What if the petitioner/spouse refuses to file the adjustment of status application?

A: Typically, the marriage-based petition requires that the parties be in a viable marriage. But if the spouse (either an US citizen or LPR) refuses to file the adjustment of status application or withdraws the application prior to its adjudication, provided the alien meets the eligibility requirements, he or she can self-petition as an abused spouse under provisions of VAWA, without the help of the spouse. Lack of physical battery does not necessarily preclude a self-petition as an abused spouse under the very liberal immigration laws. A consultation with an immigration attorney is strongly advised.

Also:

The Impact of Changes in Family Status on the Alien's Immigration Process such as Divorce from , Death of, or Abuse by a USC or LPR Spouse

http://www.visajourney.com/forums/index.ph...s-immigration-c

Q: We filed for adjustment of status. Must I remain married to my spouse until the I-485 is approved?

A: Yes. Generally speaking, in cases where a spouse was the petitioner in an I-130 application, if the marriage terminates by divorce before the adjustment of status is granted, the beneficiary will not be eligible for permanent resident status through this relationship.

Q: My US citizen spouse and I divorced before the I-485 adjustment of status application was approved. Am I still eligible for adjustment of status based on my prior marriage to the US citizen?

A: As a general rule, the regulations require that the marriage be viable. If the marriage terminates by divorce or annulment before the adjustment of status is granted, the beneficiary will not be eligible for permanent resident status through this relationship. It is strongly advised that an alien consult an immigration specialist if faced with this dilemma. If the beneficiary began the process as a K visa holder, then adjustment will not be possible other than through the initial US citizen petitioner. An exception exists if an alien was subject to abuse and qualified under the VAWA provisions.

Q: What happens if we filed the adjustment of status application, but my US citizen spouse will not attend the interview?

A: In complex situations like this one, it is always advisable to confer with a competent immigration attorney. If the spouse refuses to cooperate and accompany the alien spouse to the interview, a non-viable marriage may not necessarily be fatal to the approval of the petition. It may be possible to self-petition under VAWA. Lack of physical battery does not necessarily preclude a self-petition as an abused spouse under the very liberal immigration laws. Strong evidence of the bona fide nature of the marriage would be required and although the marriage may be non-viable, absent evidence of a sham marriage, a petition cannot be denied simply because the parties are not living together.

Now it makes me wonder...never got the status change on the AP, but a touch. Could it be possible that one of those last touches on the I-485 mean an approval? We'll just have to wait and see.....
