I read about people having there petition touched at 10PM at night. What time do VSC employee's work till?

The system updates are not real-time.

From what I understand the status updates are done by a contractor company. However, I thought that "touches" are more of an internal USCIS thing. Who knows... maybe it's on a couple of hours delay. Maybe someone just decided to put it into the system and was working after hours.

If it's not, it still doesn't.

There's no such thing as "during" citizenship. Once you are a citizen - you are a citizen. Game over.

Difference between B-2 and K-1 is that if you come here with an intent to marry on a tourist visa - that is perpetrating fraud.

In the end it doesn't matter what visa you adjust your status from, because once you are married - you are wife/husband of USC. Problems arise when AOS is filed under fraudulent pretenses.

What exactly are you asking? Is it a hypothetical question? If so, it doesn't quite belong in this forum.

If it's not, it still doesn't.

There's no such thing as "during" citizenship. Once you are a citizen - you are a citizen. Game over.

Difference between B-2 and K-1 is that if you come here with an intent to marry on a tourist visa - that is perpetrating fraud.

In the end it doesn't matter what visa you adjust your status from, because once you are married - you are wife/husband of USC. Problems arise when AOS is filed under fraudulent pretenses.

Like Cap'n Marty pointed out, there are some differences. They are mostly fine, tight rope distinctions. I'll try to be as clear and specific as I can. It is totally okay to come to the US on a tourist visa and get married. The problem is if you come on a tourist visa, get married and INTEND (on entry) to STAY in the US as an immigrant. Now, if you wanted to come as a tourist, get married, and then go back to your home country and file for CR-1, that's totally acceptable.

It's risky to come in on a tourist visa with the intent of getting married and applying for status as an LPR. That is fraud, and if they have reason to question your intent at the border, they may not let you into the country. If you do make it in on a tourist visa, get married, and then try to adjust status, and the people processing your case have reason to believe that was your intent when you arrived, they can deport you and whack you with a ban from the US. The caveat is that the chances this will happen are small, but is being banned from the country of your loved one really a risk worth taking?

(I've been talking to you as if you are the foreign fiance/e. I don't know if that's the case, so please forgive me for assuming.)

You probably won't find much support from your fellow VJers in committing immigration fraud, but if you do decide to choose this route, I highly recommend you don't post about it on a public forum that USCIS workers have been known to visit.

Good luck with your journey, and I hope the wait isn't too painful. You can do it! Stay strong.
