Question for I-864, Affidavit of Support

Timeline

My question is related to I – 864.

Since last one year I am not doing any job because I am living with my husband in Dubai. When I was in USA I had a job and my income was enough to support my spouse.

I – 864 require to submit last 3 years income tax return papers. Can any once advise me what should I do as since last one year I am not working and out of USA so i don't have papers for last one year but rest of the years i do have.

do i need to find a co sponsor or i can sponsor him.

You can submit the papers if you want, to show you are current on taxes, but it won;t matter much for the affidavit of support. You will need either assets to qualify (property, savings, shares etc), or a co-sponsor who is willing to help you out.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

We have filed I-130, I-485, I-131, I-765 through marriage and I got a letter that based on the documents submitted with I-864, the income did not meet 125% of the federal poverty line for the household. My wife who's citizen does not work and I as a graduate student make $22,000 a year and poverty line for household of two is $14,570 so the 125% is $18,212. I don't know why the USCIS sent us that letter. Any idea or suggestion? Has any body been in that situation?

There are sometimes issues when the income being used is that of the intending immigrant. Did you include a letter stating that your income is from a job in the US that will be continuing after you get GC??? If not, I would get a letter stating that from your employer and write a letter to that effect and send it with your income info... But if you have been working there for less than 6 months to a year, then they may not count it... YOu might want to look for a co-sponsor just in case...

4/4/2013. : Oath! Now a U.S. citizen!

Then I would re-clairify this situation with NVC and send another letter explaining this, a letter from your employer specifically stating that you have been employed for such and such amount since... and will be employed through ..... and send paystubs... My first course of action would be to re-clarify the situation so they take a second look and hopefully see that you do indeed qualify...
