the women im bringing here has a son 10 yrs old,and is illegitimate,fathers name is not on the birth certificate,will the father still have to sign off on the kid?father never had anything to do with him.were trying to bring him with her,she should receive her package anytime from manila,has anyone have any idea wt we shold do,i guest she should take him with her an get him a medical too,then find out at the interview wt they say, guys give me some input,thanks

If the father's name doesn't appear on the birth certificate then you have no worries. Only in cases where the father is listed on the birth certificate do you have to obtain the father's permission to remove the minor child from the country. Your situation should be easy. Good luck!

The mother is the sole custodian of the child if the fathers name is not on the birth certificate. Is there any chance the father could surface and claim custody? My wife and her 11-year old are from the Philippines and arrived last August 2009. The father threatened to claim custody because she sued for child support. Is there a forum or list for children on VJ? I've written a list a few times. In addition to a birth certificate:

*the child will need a VISA and passport

*the child will need a medical exam

*you should obtain a certified copy of his school records

*you should obtain a copy of his baptismal record from the church

*you should obtain a copy of his hospital birth record

*any medical records like vaccinations

*how good is the chlid's English? Did he go to a private school?

*Any annulment papers

*NBI clearance in all names

Republic Act No. 9255

An Act Allowing Illegitimate Children To Use The Surname Of Their Father, Amending for the Purpose Article 176 of Executive Order No. 209, Otherwise Known as the "Family Code of the Philippines"

Section 1. Article 176 of Executive Order No. 209, otherwise known as the Family Code of the Philippines, is hereby amended to read as follows:

"Article 176. Illegitimate children shall use the surname and shall be under the parental authority of their mother, and shall be entitled to support in conformity with this Code. However, illegitimate children may use the surname of their father if their filiation has been expressly recognized by the father through the record of birth appearing in the civil register, or when an admission in a public document or private handwritten instrument is made by the father. Provided, the father has the right to institute an action before the regular courts to prove non-filiation during his lifetime. The legitime of each illegitimate child shall consist of one-half of the legitime of a legitimate child."

Sec. 2. Repealing Clause. – All laws, presidential decrees, executive orders, proclamations, rules and regulations, which are inconsistent with the provisions of this Act are hereby repealed or modified accordingly.

Sec. 3. Effectivity Clause. – This Act shall take effect fifteen (15) days from its publication in the Official Gazette or in two (2) newspapers of general circulation.

you're applying for a K1 visa for your fiancee so i hope you included the child's name in your petition so she could bring him w/her. he"s a K2 so he's included in your wife's application

if you did, since he's 10, he does need to appear during your fiancee;s the interview.

Looks like others have answered you about the child.

Your fiance will not be getting and package from USEM. Just a appointment letter.

Have her do her medical ASAP in case problems arise. She only needs her MNL number and the NOA2 approval notice to get in. Passpot also.

Best to go Tuesday thru Thursday. at 1 PM. Needs some passport pics also. Tell her to wear loose fitting clothes and not to go when in her period.

i would like to share my experience,, my fiance petition me through a K1 visa petition, i have a 3 year old daughter. what he do is my fiance include my daughter to accompany me in going here in the I-129. The father of my daughter too is not listed on her birth certificate so i had the full custody of my daughter. My daughter also undergo medical exam like me. The medical in st. lukes would take 3 days becuase of the tubeculin skin test to be given to the child. The papers that I prepare for my daughter is her birth certificate from NSO, visa application fee from the bdo, passport, ds-156 2 copies and ds-157 2 copies,,,and i also bring my daughter during my interview in embassy manila to verify if the child picture that appear in the application is really your child,,, they call it biometrics as what console had told me during interview. St. lukes will get the passport both the mother and the child if they both pass the medical exam,, st. lukes will be the one to forward it to the embassy. i hope my experience helps you.. good luck...

In the Philippines, an illegitimate child is under the sole authority of the mother. It does not matter if the biological father is listed in the birth certificate or not. Father's consent is not required.

you have to file all (nearly all) the same paperwork for the child as you did for your wife/fiance. You have to pay the same expenses also. Basically you do the same as K1 but for a K2....good luck. If you did not do this upfront, you may run into delays.
