K-1 Petion Expiry Date Versus Visa Expiration Date

Hi all,

Our K1 visa was finally approved dated Nov. 24, 2009 but was only released last December 22, 2009.

There's one thing that I want to ask about the visa. While it says the visa expiration date is 22 May 2010, there is a portion below the annotation that says: "K-1 petition expires on March 09, 2010". I am not sure what that date means.

We (my daughter and I) intend to travel to the US on the first week of April 2010 because I still have to finish my work contract and also my daughter has to complete high school in order to get her diploma and other academic certificates. I have to clarify this said expiration date to make sure there won't be any issues to contend with once we are set to go..

Please, can anyone here help clarify this for us?

I-229F NOA1******* 2009-02-06 (21 days after initial application)

I-129F NOA2******* 2009-06-30 (144 days after NOA1)

Packet 3 Recd****** 2009-08-01 (31 days from NOA2)

The March 09 date means you have 90 days on a K1 to get married, if you don't you are out of status and have to return back to your country. For further clarification, you need to read the guides. Not sure why they have May 22nd on the actual visa. I don't think you can travel the first week of April because your K1 will have expired. That is the date I think you need to pay attention to. Not the May date. Other members can probably give you a better answer. Good luck.

I would call the USEM and see what exactly it means. that is weird that they would have 2 dates.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

May 22nd is on the visa because that is the date that they need to enter the country by. This date is 6 mos after visa issuance

The I-129F petition approval is valid for 4 month ... a visa must be issued during this validity period... once a K-1 visa is issued, it is valid for 6 mos.

don't worry about the petition date as the visa has been issued

+1 of what I was going to post, too. You have 90 days (exactly 90 days. not 3 months) from the day you arrive on US soil to get married as long as you are here on or before May 22nd.

If you come here today (january 2nd), then you have until April 1st to get married

If you come on April 25th, then you have until July 23th to get married

If you come on May 22nd, then you have until August 19th to get married

(used timeanddate.com for the calculations. +1 day may need to be added for the "to get married" date since I am not sure if the government considers the day you arrive as a day and I did not check to see if timeanddate.com calculates "today" as a day. i the calculation of what will the day be in 89 days considering that timeanddate.com does not calculate the "arrival date" as a day.)

Don't sweat it, friend. The fact is, most of us along in our VJ want to offer helpful info to others that are still on the road we have already traveled ahead.

SOme VJ'rs like to be a "ball hog" and answer every single question. There is one member who jumps on questions within 1 min of it being posted. I just wish the ultra veterans here would back off on the more simple and basic VJ questions and leave them for us "rookies."

For example, a question about intent to marry letter, cover letter for 129F packet, passport fotos, arrival time at the embassy or medical, etc. These basic questions are perhaps better handled by a junior member who just recently went thru this process, instead of a veteran member who did it 5 years ago.

Just sayin'!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
