Well it depends what it's denied for. It can be as simple as providing more proof. Or it can be more complicated.

As PP says, it depends on the reason for denial and at what stage it is denied.

For example, if it is denied because you were married before and not properly divorced, you will need to divorce and then re-apply, playing all the fees etc again. There may also be a charge of miss-representation to overcome.

If it is denied because they do not believe you have a bonafide relationship, you may have a chance to request a second interview with the petitioner/USC present; if not, you can appeal or re-file (re-filing is often faster).

If it is denied because of problem in the affidavit of support, you usually get a chance to submit with a co-sponsor, so it is not really denied, just a delay.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ineligibility for a visitor visa has no impact on the immigrant spouse visa. If your CR1 visa is ultimately denied after all possible appeals, then you simply don't come to the USA. Such things don't happen without good reason.

A "denial" is a denial. Asking for more information or additional processing is not a denial. If it is denied your wife will be moving to Pakistan.

OK - so if you have a pending CR-1 in the pipe, and you attempt a B-2 tourist visa, and are denied the B-2, it has little to no bearing on the CR-1. The B-2 denial will be noted, but thats usually all that will happen. The two are not related, at all.

If you have a denial on the CR-1, then suggest you follow the directions on the denial slip for 'what to do next'.

Worst-Case-Scenario - if the CR-1 is denied, the USC can file another I-130 petition.
