Ok, today my husband and I went to meet with the attorney who filed our paperwork and went with us to the first interview. The attorney says that he thinks that immigration believes my husband and I do live together. we had lots of proof, bills, pics, letters, etc, and all his stuff was at the house when they came. works 5 blocks from the house while his job before he moved with me was 40 miles away where he lived then. So attorney says he believes we live together.

But he says that immigration is going to ask him all questions about his first marriage here in the U.S. Why did he marry a woman he knew a month. he was introduced by a friend. yeah, he was lonely and had no one except 2 friends here. so one introduced him to the woman. she had a child and lived in one room. so he married her but lived with his friend while looking for an apt. during the time they were looking for an apt, they discovered they didnt like each other. so they never lived together. and he did tell her that he was not legal in the country and eventually she would have to file papers, but she said she dident want to get involved in that, so they just decided to break up. he married her to have a family here but it is hard to do that if you are illegal. so it is a catch 22. then the lawyer asks him if he consummated the marriage and he says no. so the lawyer says is that what he is going to tell immigration because if he says that then immigration will say ok, you did marry her for a card even though you didnt apply and it was a fraud marriage. if you cared about her, and were going to marry her, you would have had sex. then the lawyer says if he tells them yeah he did have sex, then the lawyer has to say he knows my husband is lying. so the lawyer said he would not go to the interview with us.

my husband really did marry someone to have a wife and a happy life here. he asked me to marry him for this reason. but yet he still has to have papers so he can live and work here. when i met him, he had a $9 hr job. and was lucky he had that since he was illegal. when i asked him to move to my area, he told me he was illegal and would have a hard time to find a job. we looked and he was turned down for a few because he didnt pass their paperwork, but finally got a job for $12. so do I think he married me for papers? yeah. do i think he married me for love. yeah. they go together. also if he doesnt have papers, then how could he ever support our family and take care of me. but i dont think that is a fraud marriage. it is honest.

so i asked the lawyer what would happen. he says the fraud unit will turn over their results to the immigration processor who will then send us a letter. if we get a 3rd interview letter, its a good sign because they just want to ask him if he had broken any laws since he applied. or we could get a denial letter, then file for appeal. which could take 2-3 years. during which he could be given deportation orders while they decide. or he might win an appeal. if he loses, he could file for amnesty. or the laws might change in the mean time. but once he has lost his marriage case, he can never file again under that.

it is so confusing to me. we have our interview on the 19th. its stressful.
