Can anyone tell me the difference between these...I am having trouble finding a solid answer to this.

I am currently in Australia with my wife(where we got married) on a tourist visa. So since my permanent residence is in the states I had to file through the I-130 to the Chicago lock box and my application ended up at the California Service Center which I have received receipts for. Now I have been looking at some things that say I might have to go back to file an affidavit of support...is this true?? Anyway around not having to go back without her?? Also if I have to take an interview do I take it at the embassy out here...or do I have to fly home for that as well??? Please help!!! Thank you sooo much!!!

K3 interview takes place in the country where the marriage occured.

The interview for the CR1 takes place in the intending immigrant's home country. IR1 is same as CR1. The difference is how long you've been married at the time of green card issuance.

Well in theory, perhaps you can file and interview in Australia. There is a process called Direct Consular Filing. There is a link at the top of this page to the guides, you will want to have a look at the DCF instructions there.

Some consulates will allow you to direct consular file if you have been in the country for x number of months - some are a little more lenient. It would be a good idea to speak to the consulate in Sydney and ask them what their prerequisites are. Also you could post in the Aussie thread here on VJ, i'm sure someone there can help you out with questions about that.

any nvc processing can be handled outside of the USA.

I suggest notices be sent to usa address from NVC, then you send off all documents from Oz.

but ---

when you have NOA-2 from USCIS -

call NVC about 3 weeks later, get your NVC case #, then get the DS-3032 kit via email from NVC (a NVC tele-operator will get yer email addresses, and send it to you ). AND THEN :D you can handle all payments electronically (need usa bank account to make that work ) but the flow then becomes payment portal driven - you can keep up with all statuses via the payment portal.

ps - i suggest not pursuing the K-3 .. Processing timelines for the I-130 have decreased so much, it's only a few months extra for the CR-1 - which is, IMO, a superior visa type.

Assuming you are the US Citizen, the interview is for your wife, not you. It would be in Sydney.

You file the affidavit of support at the NVC stage. They consider employment income that will continue from the same source in the USA. If you left your job, you'll need a new one, significant assets or a joint sponsor who qualifies.

DCF is not really a viable option at this point, since you already filed normally.

Facts are cheap...knowing how to use them is precious...
