Can anyone tell me the difference between these...I am having trouble finding a solid answer to this.

I am currently in Australia with my wife(where we got married) on a tourist visa. So since my permanent residence is in the states I had to file through the I-130 to the Chicago lock box and my application ended up at the California Service Center which I have received receipts for. Now I have been looking at some things that say I might have to go back to file an affidavit of support...is this true?? Anyway around not having to go back without her?? Also if I have to take an interview do I take it at the embassy out here...or do I have to fly home for that as well??? Please help!!! Thank you sooo much!!!

I am confused are you the USC or the intending immigrant?

But how it works the I-130 is for the CR1 visa (for spouses and grants a green card upon entry with the visa that is put in the foreign spouses passport AFTER all is approved and interview in the home country of the intending immigrant)... A k3 is also for spouses but it is not an immigrant visa and takes the same amount of time and is a BIG hassle in the end... Since you are married you cannot apply for a K1 which is a fiance visa

You filed the I-130, now you wait for USCIS to approve the petition (usually around 3-4 months)... Then it goes to NVC... You pay the fees and file the paperwork for the intending immigrant AND an affadavit of support (filled out by the US spouse saying that he/she can support the incoming immigrant)... Once approved at NVC your foreign spouse will get an interview at the US consulate at their home country...

The spouse will most likely not be able to enter the US while waiting for the visa... Total process is around 6-9 months...

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!

K-3 = spouse visas who will have to apply for adjustment of status after entry to the usa. they are also not allowed to work until they receive an EAD.

CR1= spouse visas for couples who have been married for 2 years or less. will not have to apply to adjust status, and are eligible to work upon entry. they are also issued a 2 year conditional green card, which they will have to later apply to remove conditions and receive a 10 year green card.

IR1 = spouse visa for couples who have been married 2 plus years. will not have to apply to adjust status, are eligible to work upon entry. they will be issued a 10 year unconditional green card.

When you file the I130, your wife will be issued the cr1, if you've been married less than two years. This is the two year green card.

If you've been married for two years or more, the Ir1 is issued. That is the unconditional ten year green card.

The i129f is a nonimmigrant visa.

The guides at the top of the page has a lot of details for you to read.

Your wife will interview at the US embassy in her country when it is time.

As far as the affidavit of support, do you have a job in the US?

If you do not have a job in the US or if you do not make 125 percent above the poverty line, you will need a co-sponser. You don't have to go back to the states to fill this form out.
