OK so I know I will have the I-864 to fill out and send back, heres my question, dilema etc. I am only working part time due to child care arrangements and caring for my grandad, so I know that I wont qualify under the guidelines of sponsoring my husband. My brother said he would sponsor us. So how do we go about this? I know he files joint tax returns with his wife, will they both have to sponsor (it wont be a problem just asking) and if so, do I fill out a form as well as them? Do they fill out seperate forms or will thier form be joint?

Also need to mention, I have been part time for going on my second year, I am under the impression I need last 3 years tax returns.

last year- part time

year before- did not file due to no income

year before (3)- filed jointly with my ex (he was main source of income) and wont give me a copy of tax return.

You can have only 1 Joint Sponsor, who will fill out an I-864 with appropriate supporting documentation. If your brother needs to include his wife's income to qualify she would be his Household Member, they would jointly fill out an I-864A.

As the Sponsor you must submit an I-864 with appropriate supporting documentation. You need only your 1 most recent tax return, although you can submit more if it would show you in a better light. You can get tax transcripts of your past returns from the IRS, you don't need your ex.
