We would need a lot more information before we can offer any advice. I doubt the last question she asked was the entire reason for denying your visa. It was probably a combination of factors, including how you answered all of the questions. The bottom line is that you failed the interview.

Let's start out with some basic info. What exactly did the paper say?

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

If you are still working on getting your visa, then this is the wrong forum to ask in. This forum is for people who already have a visa, and then have changes in their circumstances that complicate their immigration case.

I assume that you are talking about an embassy interview. The embassies in different countries have different operating procedures and standards. Your best best for advice would be to ask this question in the MENA regional forum.

Good luck!

Moved from Effects of Family Changes on Immigration Benefits Forum as this relates to an interview at the Embassy

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

You don't say what type of visa. I am assuming CR-1 because you mention your "wife". You were not prepared for the interview and failed because it was not clear that the visa was for other than immigration benefits. It is YOUR responsibility to prove this. You can appeal this and wait for months or simply accept the denial and file another petition and start over which will be faster and cheaper in the long run. Try again and do a better job of documenting things. It is a difficult consulate and you will have to be prepared.

Cinda,

:time:

Here is a link for the pinned topic on returned petitions to US. You have to get past several pages before you will find information that might help you...around page 8 or 9.

http://www.visajourney.com/forums/index.php?showtopic=3896

If your petition is returned to the states, you will should get a chance to respond. First your file will be sent to the NVC and then to the service center. The service center will issue a NOID or a NOIR. You will only have a short time to get the evidence that they are requesting. Do not go past the time they give you. After you send in the evidence, they will review it and make a decision. If they re-validate it, they will send it back through the process.

This is not over...try to keep your spirits up. Good luck to you and your spouse...

Please fill in your timeline.

We may be able to answer if you provide the exact wording of your denial notice.

The same thing happened to me but mine was a K1 visa. It's still on AP but just like yours, it was going to be sent to be revoked.

Your spouse from U.S. should contact a congressman or a senator to help you out with this process. As soon as the congressman's assistant got involved on my process, the consulate here agreed to review the whole thing and asked us to send photos and emails and any other kind of evidence after a couple of weeks. Only trouble is that it's been already 2 months and so far, no decision from them. If it takes too long, my fiancee and I will probably live here in Brazil or try a CR-1 visa with her living here...we're tired of strangers making decisions about our future and we're also tired of been treated like liars from people who don't even know us.

It's ridiculous how sometimes they just assume you're lying based on your nervousness.

This is the topic I made...I explained everything that happened and everything my girl and I did...you can read it if you want.

I'm really sorry that this happened to you and I wish you good luck!

All the best!

Rodrigo
