Ok...

So....

-I am a college student

-I make no income

-My parents have filed Tax Returns for me the past, and they have filed once again this year and claimed me as a dependent

-My husband and I live seperately from them

-My parents are willing to fill out I-864 supporting my husband for AOS

-I will out an I-864 put the number zero like everywhere since I have no money

-I check the box marked a in the first question which states that I am the petitioner blah blah blah

-Parents filed tax return jointly. They exceed the 125% poverty guideline but only because of their joint income

Questions:

-Do my parents each fill out an I-864 seperately or together?

-If seperately, do they check box e "I am the __first __second of two joint sponsors" or just fill it out in box d which says "I am the only joint sponsor". If this were the case my mom or dad would only sign papers without the other one signing.

-I don't fill out I-864A right? Since we don't live with the parents?

PLEASE PLEASE PLEASE HELP!!

Timeline:

March 22, 2005 - Sent in Petition for Fiance Visa (i-129f)

March 29, 2005 - Had to resend petition (insufficient stamps)

April 8, 2005 - Attempt #3 sending Petition (is there an unknown conspiracy against me? i put $3 worth of stamps and it's returned to me)

April 21, 2005 - Received Receipt for k-1 visa (NOA #1) receipt was dated 4/11/2005

May 2, 2005 - Received NOA #2 (finally these people are getting their act together)

May 12, 2005 - Found out that NVC sent in my petition and all that good stuff to Korea on May 4, 2005 (i can't express into words how happy i am)

June 16, 2005 - Looked up our case number online to check our interview date..and our number was there!!!

Our case interview will be on July 14th 2005!!!

July 14, 2005 - Interview. and it was a....SUCCESS!!!!!

July 21, 2005 - My fiance and I are in the US of A FINALLY!! We have 90 days to get married.

September 21, 2005 - Coincidentally, we got married exactly 2 months after.

September 23, 2005 - Starting the Adjustment of Status and EAD process.

I am confused about this issue of 2 Joint Sponsors. In the past, only 1 Joint Sponsor was necessary since a Joint Sponsor's household must be able to support the immigrant. There would never be a need for a 2nd Joint Sponsor.

That aside, either parent could be the Joint Sponsor and sign the I-864, both parent's financials can be shown on that I-864 if they jointly execute an I-864A.

So basically, one of my parents would fill out an I-864 and the other would fill out the I-864A?

The reason why I'm so confused is because if you look in the most recent version of I-864, in the very first part, it has choices...this is what it says...

Part 1

I,___________, am the sponsor supporting this affidavit of support (Check only one box)

__a. I am the petitioner. I filed or am filing for the immigration of my relative.

__b. I filed a worker petition on behalf of the..................

__c. I have an ownership interest................

__d. I am the only joint sponsor.

__e. I am the __first __second of the two joint sponsors. (Check appropriate box)

__f. The original petitioner is deceased. I am the substitute sponsor. I am the intending imigrant's _________.

I chose the first one (option a) to fill out an I-864, but which one would my parents choose?

d or e?

And if they were to choose e would my mom be the first and my dad be the second meaning they would fill an I-864 each or would we choose e and have my mom fill out an I-864 and my dad would fill out an I-864A?

If my mom would choose option d then I would assume my dad would fill out an I-864A right?

Please help. I know this must be very annoying but I want to get this as soon as possible without having it returned to me asking me to do it again.

Are you looking at the instructions for these forms? I hadn't for the new I-864 when I first began posting in this thread, but now that I have I see that the instructions explain about 1 or 2 Joint Sponsors, and the instructions specifically explain how to select the proper box for this Part 1.

If you look at I-864A it has parts 1 and 3 clearly labeled for the Household Member and part 2 clearly labeled for the Sponsor (who would be a Joint Sponsor, in the situation that you are proposing) - clearly it is not completed by the Household Member alone, as I told you in my first post in this thread.
