First interview in the consulate of Guayaquil Ecuador

hello my fellow memeber,so i have question that hopefully someone can answer. So. I recently got married in ecuador with the love of my life. I got married according to ecuadorian law where i had to stay 75 consecutive days before i got married,this new law just got pass in july 2009,so i was planning to get married in august,but couldn't due to the law.Had a party planned and my whole family there,moms and brother,but i still had the party because its what we both wanted.So i stood their 95 days and i had blast becuase i spend it with my new wife and i usually stay only a month since 2005 so i can see her,but with the new law i stood and we finally goit married in october.I got back in november 1st,2009 and i can't return to ecuador because i ovestood my 90 days visa and i had to pay a fine,so i have to wait 9 months to return to the country.I already send the I-130 and received the first notce of action.I'm just praying everything goes well with everything because i want my wife to come as soon as possible.

So my question is: When my wife receives the date for her first interview do i have to be present,becasue i can't enter the country until august and i'm afraid i might find a new job that pays well and they won't give me vacation time.So is it mandatory for me to be present,we have all the proof that we are married.Love letters,receipts where i send her money and of the honeymoon at howard johnson,a dvd video of the party of the wedding with about 300 people we invited and with my and her family present,one wedding invitation with mine and her name on it,cards of people telling us good luck and congrats with the presnts they send us and about 300 photos of us and emails and text messages.so does it really matter if im there or not in the first interview.please can someone help me.thanks

First, felicidades to you and your esposa.

Second, keep good records of everything for your eventual interview...desde el principio hasta ahora.

Third, definitely contact your state representative to make sure they are in on this process with you from the beginning.

Fourth, I'm going to bet that those of us who've gone through the Consulate in Guayaquil are going to tell you to hedge your bets and do what you can to be there. If you can't return to Ecuador until August you can either have her go through it alone should her date arrive before then--or you can push the interview date until the first date that you can be there with her. Personally, it's such a nerve-wracking situation it would probably calm you both down if you are both there for the interview.

Fifth, and not useful for you now that you're back in the US--but could be for any other folks out there planning to marry in Ecuador, is to file for the Visa de Amparo in Ecuador. (yes it's un relajo, but could be worth it depending your situation or future plans in Ecuador). I'd planned to finish the process before returning the US, but even though I didn't it gave me an extension of 6 months (I think) unlimited entry. By the time that ran out and I'd returned to the US, my tourist days (the number of days you can use on a tourist visa) had restarted so I entered again as a tourist.

Thanks for the info on the law about having to reside there for 75 days. I hadn't heard about that update...

2008-10-14.....Interview--221g, asked to present joint sponsor inspite of NVC approval

2008-11-07.....Visa due to arrive. DHL truck delivering visa was robbed, Consulate required us to present I-864s and DS-230 again, had to get a new passport and other related documents

2008-11-14.....Presented all new documents in person at Consulate, visa printed same day

2008-11-25.....POE Atlanta

2008-12-26.....Green Card and 2nd Welcome Letter arrive

2010-09-02.....Date of NOA ROC 1-751

2010-12-13.....Approval of ROC

2011-01-12.....10 year Permanent Resident card arrived

2011-12-20.....N-400 Application mailed

2011-12-29.....NOA

2012-02-02.....Walk-in biometrics (appt was for 2/16)

2012-04-17.....Interview

2012-05-18.....Naturalization Ceremony

The odds approach 100% that the visa will be refused if you are not there. Have you read the embassy reviews for Ecuador, and especially the "US Consulate in Guayaquil, Ecuador" thread in the Embassy/Consulate forum? You must attend the interview with her, even if you are on your deathbed.

Try to get the interview date pushed back until you can be there -- and good luck dealing with those giggling thieves on the $12 PIN line for appointments.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
