I am new to this forum, but i've been reading on for awhile now. I've been married to my second husband for 2 years now and he is sending my adjustment of status in january. My first marriage ended in disaster but with two beautiful kids. My ex-husband was against me filing papers on the first place in 2002 when i came on j-1, we got married in'03 and divorced in '06. It was a horrible time with abuse and not being able to see my family, finally i got the guts to end it which was hard and later that year i met a wonderfull person, we got married in city hall in '07 and started building our future but then the crisis hit and for the last year he had to work 4 hours away from me, we see each other almost every weekend and of course all holidays, he is also in trade school and we hope to open up a bissiness of our own once he finishes. My kids live with their dad but i see them every day, im their caretaker basically. My husband is such a sweet man, he's been saving money without telling me and wanted to supprise me later on that he got all the paper work ready, he really wants me to go see my family, i haven't seen them in 8 years. Little did he know i checked his personal saving account and found the money that i didn't know about hehehe. Now we have it all ready to send. I just wonder if it's gonna be a problem that he spent the last year commuting home and staying with friends to save money, it's been so hard for us. The lease has both of our names on it but the tax return shows that he filed in a different state. I know that we are real and we still love each over no matter how hard life is hitting us but proving that to people that don't know you is so hard. We both have so much history behind us, will it be a problem?

03/31/2010--------biometric appointment for i-765 (sheesh, i hoped that wouldn't happen but oh, well)done in 2 minutes!!!!!(day 57)

04/01/2010--------touch on i-765 (oooh, all the touching makes me giggly) (day 58)

04/16/2010--------EAD production notice (day 74)

04/26/2010--------EAD recieved in the mail (day 84)

04/28/2010--------interview (day 86) approved

05/28/2010--------green card recieved!!! (day 116)

Go through the list of requirements to prove Bonafide Marriage, and get as much of that together.

Joint bank accounts, joint tax returns, joint ownership of property, cars. Joint leases. Joint insurance. Named as beneficiaries on life insurance and medical insurance. Joint credit cards. Any other joining of financial interests (the theory is that if one is willing to risk your property and money the relationship is more likely valid) Government documents showing common address, drivers lisence, etc. Photos are good, kind of expected, but NOT primary evidence.

People who are genuinely married don't have problems to adjust, as they are able to answer questions truthfully and in a way that makes sense, just as you explained it here. You have nothing to worry about and most likely the I.O. will not even bring this issue up during the interview. Relax.

The lease has both of our names on it but the tax return shows that he filed in a different state. I know that we are real and we still love each over no matter how hard life is hitting us but proving that to people that don't know you is so hard. We both have so much history behind us, will it be a problem?

Hey lll-lll,

My hubby and I spent 5 months apart before we were married as I was on a seasonal work visa and could only find a company to sponsor me out of state. We were 12 hours drive apart... We visited each other every 3 weeks. I think with the economy right now this happens. I know an american couple where the husband had to spend weekdays working in the CA bay area 3 hours away for some months as he had no work here.

When we filed for AOS we had my husband's family write affidavits supporting our marriage. The relatives mentioned in the affidavit that they knew we had visited each other throughout our time apart.

I think you'll be fine as you have a lease and a lot of history together. Best of luck to you :thumbs:

What visa are you on now?

I think the person is out of status, she said she came in on a J-1 visa and she hasn't seen her family for 8 years. No visa would cover such a long time.

The question is : Did her J-1 visa have the 2 years home residence requirement?

I didn't have a 2 year requirement, so i guess at least i'm good there :blush:

hopefully, our life will turn on to a better path now, all i need now is to actually convince my hubby to have a baby, he is really adamant about it, he has kids from previous marriage and afraid that we won't be able to support another kid but i hear my timeclock is ticking :devil:

We have all the 2 lease agreements that go back 3 years, car title and bank account and credit cards, we are really not "picture" people, so we have just a handfull. The only thing is his mom really don't think i'm good enough for his son, so....but his sister is cool, never met her though, they live in CA and we are in midwest.

SOmetimes i really think: u live ur life, u love each other not thinking that u actually have to prove on paper that u r together.

yeah, I think that part is BS too, I wish they would just come to our house unexpected and be done with it to be honest... but this is just how the process works and we just have to go along with it and gather up the "evidence" they want even though we think it's needless and we would not have otherwise had this evidence. Filling out your timeline in your signature will be helpful to VJ'ers wanting to give you advice...

Hey lll-lll, you can use affidavits from friends too, even his sister could write something, though with all your financial evidence - I think you'll have lots of evidence. Agreed it's annoying we have to prove our relationship is legit, but it is what it is. At least we're in the same countries as our hubby's not stuck overseas like people petioning for fiancee visas K1s or spouse petitions - K3's & CR1's. Must be even harder for them trying to prove their relationship/marriage is legit while living in separate countries.

yeah, I think that part is BS too, I wish they would just come to our house unexpected and be done with it to be honest...

My hubby and I are always saying that, why can't the IO's just drive to our house (like the Proposal movie) they'd know as soon as they step in the door that we really live together... We could be approved in just a few minutes. Plus it would catch a lot of fraudulent cases. I actually read a couple of cases a while ago on here where the IO's really went to the house. But it was for a case where they suspected fraud I think, not regular practice.

yeah, I think that part is BS too, I wish they would just come to our house unexpected and be done with it to be honest... but this is just how the process works and we just have to go along with it and gather up the "evidence" they want even though we think it's needless and we would not have otherwise had this evidence.

All they need is to show up in my house and I'll tell them how lovely it is to pick up a wet towel off the bed after he took a shower :devil: , or how he never washes dishes after dinner :devil: Will that be enough evidence for them :wacko:

We are also sending an invitation for my mom to visit, guess i'm gonna take pics of that (she hates takinh picture)

LOL !!!!! My joke too.. my husband says he knows for sure I didn't marry him for a GC, cause if I did I'd be treating him a whole lot better some times, lol !!
