CSPA does not control your situation. You are looking at the Child Citizenship Act of 2000.

What Are the Requirements of the Child Citizenship Act of 2000?

The child must meet the following requirements:

* Have at least one American citizen parent by birth or naturalization;

* Be under 18 years of age;

* Live in the legal and physical custody of the American citizen parent; and

* Be admitted as an immigrant for lawful permanent residence.

Your child automatically will be a US citizen if all four conditions are met.

You can use forn N-600 to apply for a citizenship certificate for your child after the child is admitted to the US as an immigrant. You can also apply for a US passport for the child. See the link I posted for more information.

How did they denie seven times? Something does not add up, if it's denied the 1st time they USEM will tell you to get a DNA TEST did you do that?

On or after November 14, 1986: U.S. citizen parent's must have cumulative physical presence in the U.S. or its outlying possessions for five years, two after the citizen parent's 14th birthday and before the applicant's birth. >> its complicated story.. however at least i got the information already..I appreciate it...thanks :thumbs:

crba was denied 7x..so the uscis and the usem of manila advise to take the immigrant petition

Why did they deny? If the baby is born BEFORE you became a citizen you have to apply for her greencard and she will become a citizen after coming to USA and becoming a permenant resident. But if she was born AFTER you become a citizen she should be able to directly become a citizen by going through the consulate in your country.

9/1/2009: Applied for I-130

9/14/2009: NOA1 for I-130

9/21/2009: NOA1 for I-129F (CSC)

9/25/2009: NOA1 received for I-129F (receipt of mail)

01/08/2010 : Thank you very much Jesus..... NOA 2 129F

01/08/2010 : NOA 2 I-130

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

01/20/2010: Embassy schedules interview for K3

02/19/2010: K3 interview over and approved.

EDIT: The DNA test would only be conducted between the US Citizen parent and the child.

The US citizen could not prove domicile as a US citizen have to prove you are a citizen, you have to show that you have been living in the US for 5 years two after age 14…..

OK - so time for an I-130 for the child, yes?

File one asap - there be guides here at VJ to read. My apologies for my confusion.

I know domicile is one of the tests, but I did NOT twig to it, from the OP's posts here.

they are satisfied about the proof of parentship..only domicile records of us citizen father.. husband was naturally born her in US..however cant suffy domicile since stop schooling after a certain year they were looking for.. no job that time since minor.. and basically..disaster hurricane katrina which brought up trouble piling all proof of records-- they cant accept bank statements, neither medical as they said its only 1 day.. i know it sounds crazy.. but thats how they revoke my daughters right having her us citizenship so my senator suggested even the general ad. in USEM to take IR2. sophias case was completed already dec 24. =)

Having gone thru the CRBA process at USEM I understand, it’s not crazy, just the way it is! That’s why in my post I recommend to use School transcripts that’s all they really will a accept as proof. To bad things didn’t work out for the CRBA ! In the end all that really matters is your all together as a family.

Hi, we are handling similar cases, daughter of a USC (she`s 17 months) also didn't qualify for a CRBA because of the same cause. we were also adviced to start IR2 visa process for her. We are having her interview Jan 12 2010 :whistle: Starting to get a little anxious...
