ANOTHER QUESTION

I am comfortably over the minimum income and have 2 houses, one is a rental property. Credit is not so good after my divorce 3 years ago. My wifes aunt tells me that I MUST HAVE at least $5000 in my accounts (liquid assets). Everything that i have READ on the governments forms say nothing to indicate this. ANY input on this, do they want to see a large chunck of CASH just sitting in an account???

NO, you do not have to have the cash in the bank as long as you make above the 125% poverty level for your household size... They also do not do credit checks... If your income is sufficient, then you just do the 864EZ and you do not have to put any asset info...

I was in the same situation. Salary was way above the minimum requirement...not so good credit...around 5K in the bank. When my fiance was at the interview, CO only look at the income tax transcript.

She said he asked for the tax transcript , look at it, and move on the pictures....

He did not even look at the 2 houses and bank account. He did not look at any of the assets...including employer letter and checkstub

They are correct, you do not need to have a certain amount in the bank, as long as you make the appropriate amount. There is a mention when you file for proof of support, where you can go to your bank and get a bank statement which tells how much money you had deposited last year, current balance, when the account opened, but there is no actual requirement on this. The only thing the consulate in HCM specifically requires is a completed I-134 and proof of income for the most recent tax year. They prefer an IRS tax transcript, but say they will accept copies of the 1040, W2's, 1099's, schedules, etc. under some circumstances. This is all spelled out in the packet 4 instructions.

Thanks everyone, that is what i thought from everything I have read from the government and consulate sites, and the forms. There seems to be a LOT of rumors about what is needed and required that people hear from friends and family so it can get a little confusing what is and is not REALLY required. I keep having to say "THAT IS NOT WHAT THE FORMS SAY" or "THEY GOVERNMENT IS NOT ASKING FOR THAT", but in the end i think OVERKILL can not hurt your case i guess.

Bw aware that HCMC holds petitioners/beneficiaries to a higher standard than some other consulates. There is a lot of experience here on VJ with HCMC. Take everyone's experience's into consideration as you prepare.

Greg, there is so much misinformation out there from people that have not been through the proccess; that it is best to get all info vetted here before acting on it... there are misperceptions by both those in VN as well as USC's...

You can't be too eductated when it comes to this proccess... read everything available here.. it is well worth the time spent... by going to the Asia:east and pacific forums and searching for given topics in the topics, you can see that the questions or information you are going over is not unique to you...

A phrase I have used at work for over 10 years is "Ask questions early and often" don't take the first aswer as the best answer... there is also misinformation here from time to time...

The $5000 can be helpful if you are near the threshhold for income. It can also be helpful if your income fluctuates.

With a comfortable income, you don't have to list anything else. I didn't even list real estate because if you do, you have to list your mortgages on them. Maybe one reason that dich vu and lawyers recommend $5000 is to make sure they are getting paid, to get you to show how much you got, and to see how much longer they can drag the process out and bill you.

When I petitioned my hubby I was flat azz broke, maybe I had a few hundred dollars in the bank ........they dont care about your credit, or savings . they just wanna see your INCOME ie; tax returns. They wanna see ur income is consistent for the last few years .I also put some assets down at that time like my car. Just make sure u meet the poverty guidelines.

Permanent Resident card received 11/05/07 (dated 10/31/07)! THank u LorD!

Removal of Conditions:

Mailed I-751 overnight mail to Vermont Service Center 09/10/09

VSC received the I-751 Packet 09/11/09 About 12 pm Local time

Check was cashed as of Sept 16th 2009

NOA Received 09/19/09 dated 09/14/09

I-797 Appointment Notice received 10/01/09 dated 09/25/09 (Biometrics)

Got they 10 year GC approval letter in the mail dated 01/08/10! yehey!

10 GREENCARD RECEIVED 01/20/10

Citizenship.......maybe............or maybe stay a permanent resident .......................
