AOS/Green Card Interview on January 5, 2010 Scared of denial

My husband’s interview in on the 5th and just a week away now and suddenly I am freaking out over everything. The thought of losing him is too much. I am worried because I am 6 years older than him and he is Hindu and I am though raised Catholic I have no religious following. I am 2 inches taller than him. I am worried that his name isn’t on the lease because he didn’t have a social security card when I applied. I am worried about proving his residency and that we live together. I am worried about all the things that are real and true in our lives but not sure how to prove it’s a fact and not a sham marriage. I talked to my lawyer and her prepping us actually made it scarier not a calming effect she is telling me (with a week to go and no previous warning) that his name should be on the bills there is no way to do that since we have no credit cards only use cell phones and the utilities are tied up with the apartment and he wasn’t on the lease. How do you prove someone is there when the things we use to make you there were not available until he had a SSC (he got his card only 3 weeks ago). Some of my freaking out is valid some foolish. But seriously I think the only thing I have going for me is the month I spent in India meeting and staying with his family. Why would people go to that kind of trouble just for a sham marriage? I really need him and I to get this. I want my future with this man…

Not sure if I am looking for advice or just needed to freak out and be heard.

I think you are overreacting a little bit. I know its easy to get upset and paranoid through this process, but sometimes we need to just step back and take a deep breath!

As far as religion goes, that should be a non issue. This is the United States, there is an apparent separation between church and state. My husband and I were raised under different religious backgrounds as well, and it never came up during our AOS interview, nor should it have.

6 years isn't an overwhelming age gap. There have been many couples with 20-30 year age gaps who were granted green cards without any problems. And the height thing? That's silly. Why would that be a problem? These trivial issues may be a point of contention in a foreign consulate with a high fraud rate, but things are different now in the AOS stage. Were these things presented as issues at his K-1 interview in India? Is that why you are worried?

Many couples don't have the time or ability to add the foreign spouse onto every utility bill or lease. Instead of focusing on the evidence you don't have, try to focus on the things you do have. Think about what kind of evidence you have, or can get rather quickly that will show you have a working marriage. You have documentation of a recent trip to India, that's good. Do you have any pictures? Maybe of your wedding or of things you have done together since his moving to the US? How about a bank account? If you have not added him to your bank account yet that is something you can do in minutes. Most banks will allow you to do this on the spot. He has his Social Security card now, correct? So that should be fairly easy. Does he have a state license or ID? That can show you have a common address. How about health insurance, car insurance or life insurance? Things that have both your names on it like benefit cards or statements can show you have a working marriage as well. Since the holidays just passed, were you sent any Christmas cards to both of you? How about cards wishing you well in your marriage? These could be considered a form of evidence as well.

You have a real marriage and you entered it in good faith, just remember that, be confident and honest! Good luck :)

You might also ask your landlord to write a letter that attests to your living together (that is, you & hubby, not you & landlord!).

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

All I can say is don't worry so much! I was soooo worried too. I was almost sick in the waiting room while waiting for the interview. It was awful. That was just last Tuesday that we had ours in Cincinnati where we live. It was a BREEZE! It was really the easiest part! I was imagining this big intimidating interview....well, this little soft spoken young lady was the officer that interviewing us. It lasted a whole ten minutes. She flipped through the paperwork, only asked for a copy of the kids birth certificates, ask us maybe 15 easy breezy questions, and we were out of there! So hopefully yours will go smoothly too. I worried myself to death. Spent like 2 hours getting photos and paperwork together of all this proof, we had a lawyer too, and the lady didn't ask for bills, NOTHING but the kids birth certificates! Crazy, huh?

i think what u needed to hear for advice has already been said. all i can tell u is CHILLAX ^_^ we are all worried about this process. it can be a handful and i am just like how u are~~ i worry too much so i understand. just chill!! take it easy, the age and the height arent things to worry about!! gluck!! and update us soon :)

You do realize that this thread is old and Jan 5 was almost 2 months ago. Too late for advice
