A New Dependant Coming before interview...

Timeline

My Fiance' is scheduled for his interview on January 14th 2010.

I am scheduled to have our child via c-section on Jan. 4th 2010.

The signed I-134 I sent him does not have our daughter on it as she is not yet born.

However, due to the planned c-section she will be at the time of his interview.

I don't want to send a new affidavit of support until she is actually born, 100% girl (they won't guarantee gender) and I know all information is right.

I also don't want him to have any trouble at the interview because our 10 day old daughter is not on the form :unsure:

I make the income requirement for another dependent so that is not an issue.

Do you think the consular will be okay with a 10 day old not being on the I-134??

Any suggestions?

That's a tough one...I would imagine that the current I-134 will suffice because her birth is not registered at this point. It will be right at interview time, but the I-134 is not legally binding like the I-864. You will be able to add baby JaP on that one for AOS.

On the other hand, what would it hurt to fill out the form again and send it to him? Maybe you can enter Baby (Last name) and DOB. Better yet, send a letter explaining why the baby was not added because you will not know for sure until after delivery.

I know I didn't help much...because I truly have no idea. Best bet is to call before his interview and ask the "powers that be".

Jan 22, 2010 ~~ I-131 AP and I-765 EAD approved (email notice on 1/25/10)

Jan 28, 2010 ~~ USCIS email that I-485 was transferred to CSC on 1/26/10

Jan 30, 2010 ~~ Received EAD and AP via US Postal Service

Feb 01, 2010 ~~ Received notification of case transfer via USPS

May 07, 2010 ~~ Email notification that card production ordered for 1-485

Jun 01, 2010 ~~ Greencard finally arrives w/approval date 2/23/10 (Huh??)

Done until November 25, 2011!!!

My observations.

1. There is no specific requirement to update an I-134 unless requested by the consulate

2. If you make enough, regardless of the extra dependent, then the extra dependent is not a "material fact" which would affect approval or denial of the affidavit, so it is a moot point. They do not care if the dependent is a boy or girl or what the name is. They will not attempt to say there is any fraud unless the undisclosed information could have made a difference in the consulates decision. Doesn't sound like it would.

In your case it sounds like you can either whip out a new one and Fedex it just before the interview, or go with what you have. Your choice.
