Wife in US with k3..will do I130 interview...EAD?

Timeline

Wife got her k3 in 2009....and will go back to embassy in April to interview for her I130, so that we don't pay the AOS fee.

Can she apply for EAD/SS? Will that ruin any process? She'd like to work, improve her social english after her semester at school. Would like to know if anyone can help, I tried research but wasn't able to peice together my unique scenario

She can apply for any immigration benefit she is currently eligible for including EAD. Once EAD is received then SSN....

The question will be that the EAD can take upwards of 60-90 days, so if it does arrive it would only be some days before she returns for her IV interview and the cost ($340) would seem to outweigh any possible overall benefit since you seem to want to avoid uneeded expenditures...

Just out of curiosity... is there any real benefit to your plan? AOS is $1,010.... inclusive of EAD... IR visa is $400, EAD (I-765) is $340 if you apply as indicated. A trip back home and return is ?????? (1,000?). A new medical is ?????. Seems to me to be not much savings....

You can def file a stand alone EAD application and it wont "ruin" anything. It will take around 3 months so if her CR1 interview is in April, it might not make such a difference by the time she gets the EAD.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Payxibka: Wedding in april + chance to do IV interview without medical test. Seems worth it, we have to go for the wedding anyway. But you're right, I should have filed the AOS a while back. We'll see...

Yes, an IV entry into the USA makes a person eligible to apply for a SSN (either via appropriate marking of the DS-230 Part II or in person application after greencard in hand)

Based on your timeline with an August 2008 marriage, with an April 2010 IV interview however you do NOT avoid removing of conditions (currently $545)

If you did AOS ($1010) after second year of marriage then it would actually appear to come out the same from a fee standpoint

$340 EAD fee (optional of course), $400 IV fee, $70 I-864 fee, $545 ROC fee, medical exam if you cannot use the original ($?) = $1015 - $1695+

AOS after 2 years of marriage $1010. the bogey is the second medical exam for a stateside adjustment
