I want to send my fiance my paperwork for the I-134. Should I wait until the end of the year and send my tax transcripts as i changed job in Jan of 2009 and My income changed as well. The new transcripts will list the income for this year as the employer letter lists taht as well. what should i do? please help. and even if you are making more than 15,000 you meet the 100% guidelines right?

You will be waiting a long time for a 2009 transcript as they generally are not available until sometime after the filing season closes (April 15)... some years not until June

As payxibka said, you can't get the 2009 transcripts until after the end of the 2009 filing season. Unless you expect your fiance to interview next summer, you'll need transcripts or tax return for 2008.

Unless you are US military, you'll need to meet 125% of the poverty guidelines. This is currently a little over $18K for two people.

Print an extra copy of your federal income tax return and attach copies of your W-2's as support. If you are self employed the requirements for evidence are more stringent and require copies of bank statements to prove income levels reported on tax returns. So, you can file early and just provide copies instead of using transcripts.

If the documentation you supply along with the tax returns is proper, you don't need to use transcripts.

I suggest you hold off sending the I-134 until an interview date has been assigned.

You do not need to send the I-134 to your Fiance, until you have a Interview date. The I-134 states 100%, but the Visa Officer may expect 125% that will later be needed for the 864. The most recent Tax documents would be better. If you can not get 09 transcripts, a copy of your Tax return with attached documents should be ok. Having your signature notarized while you sign the copy would not hurt also. If you do not meet the 125%, notarized documents of assets should help also. Good Luck, Bob.....

There is no benefit to wait, but you can wait until next summer iof you want. The totl amount earned in 2009 is not so important (not very important at all) what matters most is CURRENT INCOME. If you get a new job TODAY, December 27 paying $45,000 per year and fill out the I-134 tomorrow...what is your "current income"? $45,000. It does not mtter that until today you earned $3,463.28 for 2009, you NOW have a CURRENT income well in excess of the guidelines. Prove it with recent check stubs and an employment. Whichever year tax return or transcript is the "most recent" at the time of the interview is the one to send in, regardless of what it says for income.

The poverty guidelines will be revised UP on March 1, 2010 and take affect at the consulates April 1, 2010. I do not know what the new numbers will be, we will find out March 1.
