I need some answers to few questions to see what you think:

When we started our process for the K-1 I had been working making a great salary - during the end of the process I was laid off - a part time job came along which qualified for the support part of the embassy process - so took the job. We were approved and he arrived here at the end of Oct 2009. We were married this month on 12/12/09

I was then laid off again from the part time job - BUT just started a great new job making what I was making before my `1st lay off.

The job is on the other side of town - it is about an hour commute for me and since we are not familiar with this side of town - we decided to wait one more month before moving to that side of town.

BUT we need to file the AOS in a few weeks as his status is out of status in mid January.

We will not have a lease in both our names until February when we will move , the place we live now is out of lease since September 2009 but have stayed here to have stable address for this process.

So here are my questions:

Can we add the new lease showing both our names after we file the AOS as proof of living as man and wife ?

How or what will he receive after we file AOS to change his date of departure on his k-1 visa ?? ( he is really worried about this and having to leave we though we have married)

Here is someone's cover page for their AOS packet. They chose to include evidence of bonafide marriage so that shouldn't be a problem if you do include any evidences. For my application, I just followed the step by step guide but included some wedding photos since we didn't have any other proof in both our names.

First, don't worry about the mid-January date. You are now legally married. As soon as you are able to file for AOS, you should. The receipt for that application (NOA1) will be evidence that he is here legally until such time as the AOS is acted upon.

Second, when you submit the AOS (as the other poster has shown) you won't need ALL of the documentation needed to prove a bona fide marriage -- just the stuff you can provide at this time (the other poster's list is good). Things like the joint lease, joint utility bills, joint ownership of a car, insurance policies, etc. etc. need to be stashed away until the two of you are interviewed. The interviewer will ask for that kind of evidence along with anything else (joint tax returns, etc.) at the beginning of the interview. If you apply in January, the interview will probably be in August or thereabouts.

Unless the official USCIS website points you to a special link for Texas etc., that is irrelevant at this point.
