I'm asking on the behalf of my friend. I can't help her much with this, since I did my 751 like most other people ( not on the grounds of a divorce). Her GC expires in February and she's in hte process of getting divorced. I don't know what to tell her. I know she needs the divorce decree to do it without the husband. I have no idea how long it's gonna take them to get divorced. What can she do now? Like I said, her window opens sometime in February. Just wait it out and apply in March/April or whenever the divorce is through?

She does not have to wait until her 90days open, as soon as she divorce she can start the process. these kind of cases are hard and the most important thing is to prove that you entered in the marriage in a good faith. Consulting an attorney wont be bad.

Thanks for your input. Like I said, she's getting divorced right now. I'll ask her when she thinks it's gonna be final. But she has to wait until it's final, right? Otherwise she basically could start right now.
