hi to all,

I need your help and advice! my fiance and I planning to get marry in Feb 2010, he only stay here for about 3 weeks. First of all what are the requirements he need or documents he will be bring here in the Phil? and how long it will take to have our mariage licence will be released? thanks!

Hopefully you know people in municiple hall. I think it took us 3 weeks to get everything done for the wedding. He will have to go to the embassy do an affidavit saying he is single (affidativit in leu of legal capacity to marry). If he was married before, any divorce decree (original with stamp or seal). The only real wait is if you have to wait 10 business days for the marriage license. That is the short and sweet that i can remember. Just read the links provided above and everything should be all set. I would also talk to the people in your municiple hall.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

03/15/08- Met online

01/03/09- Met in person for the first time.

01/15/09- Got engaged

02/18/09- Sent I-129F

02/20/09- Recieved at Vermont Service Center

02/23/09- NOA 1

02/24/09- Check cashed

You can call your city local civil registry office to inquire. If you're from Quezon City, they would advise you to ask your future husband to download the application form, fill it out and bring it to Philippine Consulate in his state to be authenticated, send it to you with a copy of his passport and 2x2 photo, then you go to city hall, submit those and your documents and tell them that his certificate in lieu will be submitted when he comes. Anyway, even if the 10-day process is over, if you don't have the Certificate in Lieu, the license won't be released. That's what I did when we married in March. We didn't have to wait for 10 days because application for marriage license was already filed before he came.

You can call your city local civil registry office to inquire. Yes, you can get it faster if you know someone in municiple hall. We could have had ours in about a week, but I had 4 weeks there. You just need to maybe "grease" some hands. Just talk to your municiple hall and see what they say for making it faster. I know of one guy that only had 2 weeks to be there and got everything taken care of.....it's all in who you know. I think there was supposed to be some sort of seminar at municiple hall also....but we didnt have to do that because my wife's mom was in politics there, so they waived that. They said we had enough stuff to do for the wedding.

Yes, you can get it faster if you know someone in municiple hall. We could have had ours in about a week, but I had 4 weeks there. You just need to maybe "grease" some hands. Just talk to your municiple hall and see what they say for making it faster. I know of one guy that only had 2 weeks to be there and got everything taken care of.....it's all in who you know. I think there was supposed to be some sort of seminar at municiple hall also....but we didnt have to do that because my wife's mom was in politics there, so they waived that. They said we had enough stuff to do for the wedding.

I would not recommend to "grease some hands" or do something out of the norm just because your family member has some political power or not ,it can come back and bite you! I've seen it happen.....You can complete the whole process in 10-12 days, mine took 11 days one day for the wedding at my wife's home and 10 day waiting period .

There is a seminar but doubt the Kono will need to go, the lady at the Reg. Told me the seminar is in Tagalog and I did not need to attend but the wife did.

When you land in Manila go down to USEM for Certificate of Legal Capacity to Contract Marriage Fee $35.00

Don't let the marriage license laws of The Republic of The Philippines put a dent in your wedding plans.

Here's what you need to know and what documents to bring with you before you apply for a Republic of The Philippines marriage license. We recommend getting this legal aspect of your wedding out of the way about a month before your wedding date.

Age Requirements, Parental Consent, Parental Advice:

If you are under the age of 18, you can not get married in the Philippines even if your parents are okay with the marriage.

Individuals must be at least 21 years old to get married in the Philippines without written parental consent. If your parents cannot appear with you before the local civil registrar, a legal affidavit with the signatures of two witnesses may be accepted.

Individuals between the age of 21 and 25, must "... ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefore. A sworn statement by the contracting parties to the effect that such advice has been sought, together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement."

Waiting Period:

There is a waiting period of ten consecutive days while notice of the marriage application is posted on a bulletin board outside the local civil registrar's office.

Fees:

Check with the local civil registrar for the fees charged for a marriage license. Fees for a marriage license may be waived if the couple applying has no visible means of income or has insufficient income.

Pre-Marital Counseling and Family Planning Seminar:

If either of you are between the ages of 18 and 25, you will need to show proof to the local civil registrar that you have received marriage counseling. If you do not receive marriage counseling, your marriage license will not be issued for three months. (My wife was 28 so who knows? maybe, maybe not)

Previous Marriages:

If you have been previously married, you will need to provide the death certificate of your deceased spouse or the judicial decree of your absolute divorce, or the judicial decree of your annulment or declaration of nullity of your previous marriage.

Witnesses:

Two witnesses are required. Witnesses must be of legal age.

Officiates:

Members of the local judiciary; priests, rabbis, imams, ministers of registered churches or religious sects; consul-generals, consuls, vice-consuls. Military commanders in the absence of a chaplain and ship captains and airplane chiefs can solemnize marriage in article mortis.

If you use a religious officiant, one of you must belong to the officiant's church or religious sect.

Wedding Locations:

Marriages must be solemnized publicly in a church, chapel, temple, judicial chambers, or offices of consuls. The only time a wedding can take place elsewhere is if the wedding is articulo mortis, in a remote location, or if the officiant receives a request for a different location.

Proxy Marriage:

The Republic of The Philippines does not allow marriage by proxy.

Common Law Marriage:

Yes. The Family Code of The Republic of The Philippines states: "No license shall be necessary for the marriage of a man and a woman who have lived together as husband and wife for at least five years and without any legal impediment to marry each other. The contracting parties shall state the foregoing facts in an affidavit before any person authorized by law to administer oaths. The solemnizing officer shall also state under oath that he ascertained the qualifications of the contracting parties are found no legal impediment to the marriage. (76a)"

Hello Bulex, We got married for only 5 days he visited me here. All you have to do arrange the marriage before he arrive here in the Phils like I did before. and I did not wait for 10 days to get our marriage license it took after the marriage done at the same day. What place you living in? I'm from Alabang.

That is why I said to talk to them. If your fiance was never married they can start the process, but still need the affidavit from the embassy. We didnt have to pay extra for the license, but we paid a fee for someone to take the signed license to manila to the NSO so we could get the certificate back sooner. We got it in a month instead of up to 3 months like the norm. If you talk to municiple hall, they will tell you if there is a quicker way..normally it ends up meaning more money...hence the greasing of the palms..but they will tell you if it will cost more. I dont go and offer up...but since they all think we are rich americans, they will try to charge a priority fee..if they can guarentee it...I see no problems with it. In my case, I was told they would have had it quicker....we had my wife's nanay with us during the application process, but we had the extra time to wait. Yes you can get it done in 2 weeks without any problems as long as you submit everything needed right away.

If he has been married before he needs to bring his divorce decree, his birth certificate, passport, and he has to stop at the U.S. Embassy to get a legal affidavit of marriage. My advice is since you have applied for the K-1 visa is to do that because there is lot less paperwork to fill out and will get you to the U.S. quicker to be with him and get married here

I just did this. My wife went and paid for the marriage lic before I came and had all the paperwork filled out. The first day I arrived I went to the Embassy and got the ability to marry. He will need to bring any divorce papers. You both should go as they like to ask a few questions sometimes. He has to be prepared to fill out some paperwork stating where he is staying and a phone number of an emergency contact in the US. This is good for you as you can see where you will need to go for your interview latter.

We then went back to the courthouse and took a marriage class and finished up with the papers for the marriage lic. You then have to wait 10 days and go back and pick up the marriage lic and take it to whoever is going to marry you. You can do it in 12 days but you will be busy. Make copies of everything. There are copy machines in the courthouse if you are in Manila. Make sure there are no holidays when things will be closed and go to the Embassy early and grab a number.
