Timeline

Hello to everyone, Merry Chrismas....Well I have few question, Its been over a year now since my K1 Interview, and now we are about ready to send the need requirement,(its about co-sponsor) My question are. Do I need to have a new medical?. Is it our case will be under AR since its been over a year before were going to send the papers,.. There is anyone been in my situation now,? Thank you In advance for the reply..

AOS-

09/15/2010 - Sent AOS

09/23/2010 - Receive Text and Email

09/27/2010 - Receive Hard Copy in the Mail (EAD,AP,AOS)

10/13/2010 - RFE on my I-485( waiting the letter on the mail )

10/18/2010 - Biometrics Appointment (touch AOS, EAD at the same day )

10/22/2010 - Sent RFE

10/26/2010 - Touch ( received RFE Under review )

Yes you need a complete medical from a USCIS designated civil surgeon.

No you won't be under AR because it's been over a year.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I would make sure that the time for the submittal of the evidence has not expired. they may think the case was abandoned if it has been a year. You will probably have to reopen the case.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

I would make sure that the time for the submittal of the evidence has not expired. they may think the case was abandoned if it has been a year. You will probably have to reopen the case.

They have not filed anything yet so no case submitted, no case to abandon, no case to re-open

they said it has been over a year since the interview. Maybe they are doing the adjustment of status now? Maybe I misunderstood the question...there is no timeline for them to verify this.

Your right... could still be K-1... I had assumed AOS...

regardless of the scenario, a new medical is certainly needed... hard to tell about any other complications

Yes the medical is only good for 6 months in most cases. that is why you need to do it close to your interview from the way i understand it...because the visa is good for 6 months or until the medical expires right?

Sorry for the confusing question, well this is what happe I am still on K1 I had my Interview last Nov'08 but we had problem of my fiance Income and the Consul did not accept our Co-sponsor, my fiance did not provide the Required requirements over a year now because he's been through a few medical problems, and to make sure that our case is still open we keep contact the Manila Embassy and sent his Medical records why he is still not be able to find a new job we didn't abandon our case, and we called the NVC when he got his job and they said that our case is still open, and now were about to send the letter from his new job, stating his new income,. and now were really hoping that waiting for visa won't be that long, and I dont know if I have to undergo another medical..which I guess Yes.. and worried that we will be under review since its been over a year now since we going to send the papers. thank you again..

Well, all you can do is have him send in the affidavit of support and see where it goes from there. You will probably have another interview or at least have to provide the embassy with a new medical.
