Can one claim a Spouse as a Dependent>?

hello,

i have been married since May, and I figure she wont be here until late february through the CR-1 program.

i have been supporting her since may.

can i claim her as a Dependent in my tax return?

no, but you can file a "joint" return with her as your wife.... You will need to get her an ITIN (IRS Form W-7) in order to do this as she will not be eligible for a SSN

..... when she is here in Feb, you can apply for her SSN and get it in mail in a week or two. She may also receive the

Green card in mail by that time. Then, you may file a joint tax return.

Since you were married in the tax year (2009), you sure can file as status married.

10/09/2009 - spouse emailed ds3032 to NVC

10/09/2009 - AOS status changed from 'In Process' to 'PAID'. AOS Cover Sheet printed

10/10/2009 - cover sheet + I-864 package Sent out

10/15/2009 - NVC received I 864 package - AVR update

10/21/2009 - snail mailed ds3032

10/30/2009 - ds3032 accepted, in response to our email sent on 10/09.

10/30/2009 - IV Application Processing fee generated

11/02/2009 - NVC sends email to pay the IV fee, $400. Fee paid. Status: 'IN PROCESS'.

11/03/2009 - Status changed to 'PAID'

11/03/2009 - (K3 is out of AP and sent to the embassy, per NVC letter)

11/03/2009 - false RFE for ds320.

11/04/2009 - mailed ds230

11/06/2009 - delivered

11/12/2009 - received, per AVR

11/23/2009 - Sign in failed

11/24/2009 - Case complete

11/30/2009 - Interview scheduled for 27-JAN-2010 @ Mumbai

You have to apply for spouse ITIN. once you get it you can use it as spouse SSN. There instruction in ITIN letter what to do once your spouse comes to usa and apply for ssn.

Call the IRS. If you support a child, you can also file head of household and could still claim your alien resident spouse as a dependent. So call the IRS and ask VERY specifice questions before you file!

You can file a JOINT return but you CANNOT claim your spouse as a dependent..... Correct use of terminology is important.

6/5/13 IV bill shows paid, DS260 available

6/14/13 CHILDREN'S PASSPORTS ARRIVED!!!!

6/14/13 filed online DS-260 for both kids

6/16/13 emailed Supporting docs for DS-260 for both kids

7/9/13 CHECKLIST for both kids...sad.png

7/9/13 checklist response sent (birth certs and passport Bio Page <again>)

8/2/13 CHECKLIST both kids

8/3/13 checklist response sent (I-864 AGAIN and paystubs - sent last 6 paystubs)

9/11/13 Medicals completed in Toronto @ Dr. Seiden's office

10/9/13 INTERVIEW APPROVED

10/25/13. SSN cards arrived

Okie I am confused on this one....You can do a joint return but cannot put ones spouse as a dependent correct?

January 2007: We met at work

December 2008: He proposed

July 4, 2009: Married

April 2010: Moved to Beirut, Lebanon

January 8, 2012: We welcomed our first child Luna Noelle to the world

Correct, a spouse cannot be a dependent, you file jointly and take the standard deduction for married filing jointly (if you do not itimize)

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

4/4/2013. : Oath! Now a U.S. citizen!
