I believe you shouldn't file G-325A for your child, if he is only 13.

According to the instructions:

" You must submit a completed Form G-325A if you are between 14 and 79 years of age".

twood,

You answered my first question but not my second.

I note that your response is written in the future tense - how old might he be by the time he arrives and might be applying for adjustment of status if he arrives as a K4?

In any event, a 13 or 14 year old should be capable of signing his own name.

Yodrak

The child is 13 and he will come to the USA with his mother who is my wife.

Thanks

Thanks for all the help.

I filed a I-130 for his mother not thinking I had to do a I-130 for him too and from the other posts here it now seems like I was correct in the first place.

Probably turn 14 before he lands in the USA unless approvals really speed up soon.

Thanks again.

Hi,

You DO NOT fill out a G325a for a step child...no matter what age they are. Only a husband and wife have to fill out the G325a's...any other relative relationship does not. No where in the instructions does it say " You must submit a completed Form G-325A if you are between 14 and 79 years of age".

I don't know what form you are looking at, but it certainly does say that in the I-485 instructions and if a K-2 or K-4 is age 14 or older they complete the G-325A as part of their AOS submission.

jazzy,

You may be looking at a form I-130 or I-129f. As mdyoung suggests, try looking at a form I-485.

twood has yet to answer my question about what form he is asking about (G-325A is not a stand-alone form, it always goes with something else), it helps to have essential information to give accurate answers to questions.
