when there is not enough evidence for bona fide marriage

Honestly, I'm very concerned about our interview for green card coming in January. We really have very few of argumentation proves of bona fide marriage - let's see, we have about 140 photos and we WILL TRY t open joint bank account (not sure if we can since I don't have any ID on my new last name), couple postcards, couple emails, and that's gonna be it. I don't drive, husband is not going to put me in car insurance and we don't have medical insurance and not about get it soon (again, I don't have ID on new last name), I don't have cell phone and he gets his through h9is company . And on top of that - we live with his parents and sisters in big house (12 people all together), all bills on his dad's name and nobody gonna change it (we plan to move in 4-6 months but I should start work before that). So, seems like we have excuse for everything, huh :devil: I even thought about registering our kitty-cat on both names, but we not gonna get his license on time... Interview is in 3 weeks, I actually expected EAD first, but I guess, not gonna have it before interview. Anyway, I hope, affidavits from relatives who know us as a couple would help, is it better to have one from all adults in our house (5 people), or separately? and they gonna sign them and everything, but if somebody has examples of common phrases to put, could you give me them?

And if you give advise about whole situation, please, comment, I will appreciate it...

just to add - our marriage is not fraud, it's real, but some proves we can't just make, especially in such short time + don't have extra money (like getting insurance), I hope, they here are good psychologists and we would pass separate questioning interview and we are same age (24), but riding about how people prepare for such interviews and compare with what we have is killing me...

no, he thinks, he is too young to get one... and he doesn't really understand, how those types of documents are important for interview, he is tooo careless... I will try to make him read my post later...

and, again, if somebody has example of letters from relatives, who know us as a couple, I would appreciate help.

You should get affidavits from all your household members!!! Especially, if they attended your wedding, but not neccesarily. Also, ask them to get affidavits notarized, since it "adds to their weight". Driver's licenses with the same address, state ID's, Costco cards, letters addressed to you both to your address. U cold also get a statement from your husband's job which says you are his emergency contact.

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.

I didn't have many wedding pictures. None of my family members were here to attend anyway. You can open joint accounts without any form of ID from the US. Thats what I did. Used my Passport. It was way later when I got my SSN and Drivers ID. At the interview, the AO wasn't interested in any documents or pictures. He was interested in us and our marriage. They rarely seperate you during the first Interview, unless they suspect you from day one. Be confident and don't Lie.

Get atleast a joint checking account if you want to feel more at ease... it's nothing.. you just need your passport and his I.D, don't worry about the name change... I have not changed my name yet either because I don't have a SSN, but the account is in Both our names, my first name & maiden name, and his full name, different last names... when I have my name changed after receiving my EAD then SSN then we'll change it all again and hopefully take the newer version of the joint accounts listing my married name etc. to the interview...

Also my husband added me onto his existing credit card - he was really surprised too that he could do that since I don't have a SSN, he just asked if he can get an extra card for his wife and they sent one to us, no problem... with my name on it... so that's a joint credit card (that comes in REAL handy, lol). If your hubby has a credit card ask him to try and get you a joint card if he can. You don't have your EAD? PERFECT timing to start learning how to drive and applying for that driver's licence showing your joint address... But really I think it's pretty clear to them when a couple is real or not.. body language speaks volumes... also very simple things like having matching house keys, lol

Hey Rialtoma,

The affidavits should be personal and unique to you. so unfortunately there is no example affidavit. That being said there are some affidavit tips on the guide section. http://www.visajourney.com/forums/index.ph...amp;page=guides

They are not directly relevant to AOS from work/student visas though, but are useful for maybe getting some ideas for legal lingo to use/lay out.

A big help though is the I-130 instructions (i don't have a link but they're on USCIS.gov under forms.) They list exactly what USCIS needs from you if using affidavits - like the person's date and place of birth, full address etc.. Also the I-130 guidelines state what they want the affidavit to cover - e.g how the person heard of the marriage etc... Based on those guidelines you might want to put a little guideline sheet together for your family members. We did that and it helped a lot! Plus by going off I-130 guidelines you know your affidavits will be more likely to be what the IO's are looking for.

As for bank accounts I guess it depends on the bank. My bank just needed the marriage cert to change my name and also set up a joint account for us. Though I do have an SSN. I did tell them though that I hadn't changed my name at DMV and SSA and they said that didn't matter.

Also my hubby added me to two credit cards too one before we are married and one after. I don't think they care what name is given too much... It was really easy and the cards arrived fast!

You don't have your EAD? PERFECT timing to start learning how to drive and applying for that driver's licence showing your joint address...

I don't think you can learn to drive (or get the learner's permit to allow you to take lessons) if you don't have an EAD and/or at least six months left on your visa. At least that's how it is in Texas. What can you really expect from a place that gave us the "great" Dubya, though?!

DECEMBER 31 2009 - Received AP document. [DAY 57]

JANUARY 2 2010 - Received EAD & interview letter (interview will be 02/16/10, San Antonio). [DAY 59]

FEBRUARY 16 2010 - Approved at interview! I-551 stamp in passport. [DAY 104]

Get a Sam's club, Costco, Blockbuster cards... At least those are little things you can do (that dont cost any money) showing the two of you... Adding you as a credit card holder (again, does not cost and does not need a SSN)... Have the parents sign a lease with the two of you saying that you pay them a certain amount to stay there (again, free and can be downloaded from the internet at no charge)... Just some ideas.. Make excuses or make some evidence... your choice

thank you very much all for advise. I'm debating with myself - last year, when we were not married yet, my future husband went to another state and got in trouble, I had to send him some money with western union, not too much (500 backs), I have recite with our names, is it one of our relationship evidence, or, other I should hide it and don't show in interview (like I paid my future husband), it was just help from me, by that time we planned to get married, but what do you think - will it be helpful (especially in our case - we don't have a lot of papers together), or it would play against us and look suspicious???

ok, I wrote affidavit for my husband parents to sign. My English is far from perfect, so all kinds of mistakes are possible, I don't want to bother my parents in law with checking mistakes, just gonna give it to them to re-write and sign. Facts in this affidavit are all truth. Thank you for help in advance.

We are parents of T* J* D*. We know T* and K* as a couple for almost 1,5 years since they start dating. Back in autumn 2008 T* lived with us, but he spent a lot of time in her place, almost every day. They used to come over together to our house to say Hi or exchange holiday presents. T* told us about his intention to give proposal to K* in December 2008 and we were happy for them both. In February 2009 they moved to live together with our daughter and her boyfriend. When their apartment lease was finished in July, we moved to bigger house and offered T* and K* to live with us. We live together as a big family since then. They pay their share of rent to us in cash every month, help with other bills and groceries. They spend all holidays and family events with us (everybody’s birthday parties, Halloween, Thanks giving day, Christmas and New year). They make good loving couple.

How many mistakes you can find :devil: ? Thank you, again.

Curious how are social networks profiles accepted? ;) As in if you show them your facebook profile. If you have had it long enough you can show evidence for being in a relationship and stuff, and since there are dates and stuff you cannot really fake it. Any thoughts?

I don't know this for a fact, but a friend told me that she knows of someone who got denied at AOS interview for what was on her facebook... Don't take my word for this but I would definetely say that it would count as evidence that you could take along to the interview and I would not rule out that it would also be very smart for USCIS to check out your facebook/myspace before the interview to see your "relationship status". Makes sense doesn't it, since lately Everyone's on there and our whole lives are pretty much played out on those networking websites :lol:
