Hi everyone, I am new at this board but I stumbled upon it luckily because i just needed a little clarification on something.

Me and my husband (the beneficiary) went to a stoke interview in NYC in October, and it went well, and we showed all evidenciary support, etc. Now I just received a letter saying that The petition was approved. So that means that they have deemed our marriage bona fide, I'm assuming.. because its [the letter] vague. After it said it is approved, it then continues to say "the person this petition is for will be notified separately when the decision is made on the adjustment of status".. I know this is one of many steps, but if someone could give me an idea of what to expect next, and a time frame? I know they are all different, but some advice even would be great.

Sorry , as i said i am kinda new to this, and i dont really know how to do the timeline, i tried to do it, im' not sure if it is coming up. I keep seeing this biomentrics appointment thing on this forum, but I"m not sure if we had to do that. If so, I wasn't involved in any of that. That is specifically for him, right?

And the interview , the Stokes interview we went on, is that the main interview that everyone here is talking about? Or is there a separate interview aside for stokes after this?

PLenty of views, Nobody can give me any advice?

=(

Without your timeline filled in - which provides basic info, it is hard for people here to give you any advice.

Check this guide, and see what you did/didn't do - let us know, and we can go from there.

Usually a Stokes is the 2nd interview (if they doubt your marriage) which is not very common and if they said it was approved, then it was approved.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

Okay, so if we were approved for the stokes, and got the i130 Approval in the mail.. what do you think we are waiting on now? **He did all the biometrics and filled out all the forms as well.

I would ask my lawyer, but she is on vacation till January 20, and has an automated response in her emails. =( ughh..

I tried to do my timeline, like I said, but I dont think I did it right, so if you could still give me any information at all, ill be very appreciative =()

You have not provided much information for anyone to give advice or suggestions.

Did your beneficiary enter the US on a K1 or K3 visa?

Did your beneficiary enter the US and you got married in the US and sent in a I-130 and I-485 together?

From what you have posted it appears you had an interview for your husband's Adjustment of Status (AOS) and are waiting for the approval. The AOS was probably being held until the I-130 is approved. The USCIS is not fast so it may take some time for the local office to get the approved I-130 and make a decision. If and when approved you will get a letter in the mail stating Welcome to the US.

A stokes interview is a second interview for Adjustment of Status where the Interviewing Officer became suspicious. At a stokes interview you will be interviewed separately and possibly for a long time to see if you answers match.

Naturalization

3/27/14 - N400 package delivered

4/3/14 - NOA1 receipt date

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

xx/xx/xx - Oath Ceremony

He entered the Us on a tourist visa(not sure which one that is), he didnt plan on staying here permanently. his intentions where initially to work and then probably go back to his homeland. he met someone, got involved, (re instated his visa to be current) they ended up getting married, but then me and him met, .. make a long story short, we fell in love, and he filed for divorce from her, in the middle of their interviews, and their GC Proceedings, or whatever you want to call it. I believe that now since we are married and its his second marriage here, we went immediatly into the stokes interview because they are now suspicious that he was already married, when we was already going through the motions with her. Sorry if this is too much information, =( don't mean to confuse you.... So our initial interview WAS the stokes, and it went well As I stated, and they guy even said, I approve you, but I have to send the actual letter in the mail, so I got it in the mail just today. So I guess I am just waiting on the i485, which I believe is the second document. DOes it usually just come in the mail? Or will they request him to come in for a "MASTER HEARING".. I havent heard too many people discussing that, but Our lawyer said that was something we were going to do after we pass the interview. He sent both forms together to answer your last questions.

The information is very helpful and nothing is irrelevant. Your case is complicated as you already know. I have not experienced this situation, but will tell you what I know. Some of it you will hopefully already know. Maybe another VJ member with more experience in this area will add more information.

It appears you have done everything correctly so far. Most commonly the I-130 petition is sent to the Vermont Service Center (VSC) or California Service Center (CSC) for processing and approval. It is not unheard of for complicated cases to be sent to the local office for the I-130 interview as you mentioned in your case.

Your next big step will be the I-485 Adjustment of Status. This is where you will most likely encounter the most problems. Hopefully, you will be called in for an interview at your local office for the I-485. Be prepared for another grueling interview. If approved the Welcome to America letter is sent through the mail.

If your husband is denied then deportation procedures begin. A hearing date will be set which is a Master Hearing. The Master Hearing is a procedural hearing. At your first master, the charges will be stated, you plead to the charges and tell the judge what forms of relief you are seeking (adjustment). The judge will then set a time for submission of documents and the next hearing date. The next hearing date is another master hearing or more likely the individual hearing which is the trial.

It is hard to determine a time frame for your AOS interview. You can get an estimate for a normal AOS interview by clicking here. Then in the third box from the top under USCIS District Offices select your local office. Press the get processing time button and look for the I-485 under forms.

Thank you very much for your help!...

So It wasn't over with the interviews? I thought there was only one interview for this whole situation to determine validity of the marriage..

I hope that we won't have to do another, .. Maybe the second one with only require him to be there, since we already passed the first.
