Hello,

I am doing a DCF next month but I was wondering if my co-sponsor had to supply me with their 2009 or 2008 tax return and W-2.

Also when do the new 2010 Poverty Guidelines come out? Are old cases grandfathered into the new guidelines?

You will be expected to have all taxes that can be filed at your actual interview. Your income guidelines will the also those on the day of your interview. They will be out shortly effective in the spring. So they will need to get their taxes done before your interview and the income usually goes up a few hundred per household member

This will not be over quickly. You will not enjoy this.

I think the 2009 guidelines were released late January last year so you might start googling them mid-January. Good luck :thumbs:

The 2009 poverty levels were effective February 13, 2009 so expect the 2010 levels to be published around that time as well. There appears to be a possibility that the 2010 poverty level guidelines will either be frozen at the same level as 2009 or may even be lowered if you read the various news stories around this issue. why don't all of you get educated and stay up with the times the 2010 guide lines are already published. If your going to help some one at least give them the truth. now that was really hard it took me a whole minute to search google for it. this kind of ####### is why I quit using this site a long time ago it has to many people that think they know it all. but in reality they never know what they are talking about. YOU KNOW LIKE THE BLIND LEEDING THE BLIND! ! ! !

Looks like the guidelines for Supplemental nutrition assistance program to me, but I could be blind too!! :unsure:

Those guidelines you posted are not the ones that are used. Perhaps you should check your facts.

This is the correct link for the 2009 guidelines used by USCIS - the form name is I-864p (if you would care to google it) http://www.uscis.gov/files/form/i-864p.pdf

The guide you posted is the Monthly Income Eligibility Standards - for the Supplemental Nutrition Assistance Program, as far as I am aware USCIS does not use the income guidelines for the Nutrition assistance program for the I-864.

Oh and when you look at the I-864p, you might want to have a look at the notation at the bottom:

They will come out about mid-February. They take affect with USCIS and NVC March 1. They take affect with the consulates April 1.

If anyone is looking for the 2010 federal poverty guidelines that are published by the U.S. Department of Health and Human Services, these guidelines are likely to come out during the last 2 weeks of January.

Those will not work for immigration purposes. DHS/USCIS uses the I-864P (used with the I-864/A/EZ) (see what I did there?)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Okie2, before you start getting abusive with your posts you should take the time to find out the correct answer for yourself. The USCIS publishes its own poverty guidelines based upon the poverty levels. Those are the ones that they use - not the ones that you quoted. Different government agencies use different guidelines based upon the same base information but their requirements vary, just as USCIS' does. The USCIS guidelines are 125% of the poverty level. They have not been issued yet for 2010.
